Morgan and Augustus D. Pape, counsel for the Lacus- trine Fertilizer Company, of this city, Chief Justice Davis granted, yesterday, an order of injunction re- Straining Silas M. Stilwell, the author of the famous Bulwell act, and his son, Silas Jr., from removing or selling about $650,000 worth of mar! known as @ valu- ‘ablo fertilizer, and which is located in Seneca county, this State, and claimed as plaintiff's property. From ‘the complaint in the case it appears that, prior to Jan- wary, 1865, Royal W. Torrey was tho owner in fee of about 600 acres of land in Seneca county, which con- tained large deposita of marl of great value asa for- Mlizer, About the timo mhmed, in making what ts known as the now cut of the Canandaigua River, which passed through this land, about 150,000 tons of this marl was dug out and thrown on its banks, where Torrey permitted at to romain awaiting a market, While the marl still lay there Torrey conveyed the land on which it was to Henry ©. Spalding, but specially reserving to himself in the oat” his mght to the marl which bad been dug out of the cut, and providing that i$ might remain there ten years, any time during which he (Torrey) or his assignees should have the right to remove it. ‘Through various intermediate conveyances Silas M. BSulwel i one of the defendants, became the owner of the land some time in 1873 or 1874 From January, 1865, to the winter of 1866 and 1867, Torrey conveyed away from time to time portions of the marl, and at the latter date sold to Henry A. Barnum all ‘that re- mained on the ground, Barnum thereaiter continued to remove the marl up to about January, 1876, when he sold haif nis interest to Edward Pierson, and In May both conveyed their interest to the Lacustri: ‘ertilizer Company, tho plaintiff in the aetion, After alleging that the company and its prede- sessors in the ownership of the marl had expended largo sums in making it Known ip the market, where it sells ‘at $10 por ton, and that tho not value of ail still remain- ing on the ground 1a not less than $650,000, the com- laint proceeds to charge that the defendants, Silas M. Butiwett and Silas M Stiiwell, Jr., father and son, bave Bince about the Ist of August last, in violation of plain- tifl’s rights, been engaged in transporting this marl to Now York and elsewhere for sale on their own account; that one boat load sent by them to New York was ized by the Sheriff on behalf of plaintiff, but, defendants tieing the usual bond, the property was reatored jo them, and was taken and disposed of by them; that since that time defendants have continued to move the marl and transport itto market, and havo caused three boat loads, about 600 tons, of the value of $6.000, to be removed from the land, and in order to Avoid its being serzed under legal process by tho plain- tiff have caused ft to be taken to Jersey City; that de- fendants are now preparing to remove und sell further quantities of said marl, aud are threatening to remove and sell tbe whole thereof, and are engaged in selling to other persons authorities and rights to remove and kell quantities of said marl; that they are making such swles at depreciated prices, and trying to dispose of the whole in such 1 manner as to prevent its being seized or retaken by plamutf; that the defendants arc persons pl suiall means, and witl be unable to reapond to plain- ifm damages for the acts dono and threatened to bo dono by them in the premises, Upon tho foregoing facts the plaintiff’ demands an injunction against tho defendants, their agents, servants and attorneys, and allother persons claimiug by or under them, restrain- tng them from digging, removing, transporting or scll- Ing any portion of said mari or 1m any way interfering therewith. To the complaint {s added an affidavit by Edward Peirson, through whom tho plaintiff derived Mtle, in which he confirms tho statements contained In the complaint as to defendants having removed por- ions of the marl, and recites conversations of the jatter in which they claimed the right todo soas owners in fee simple of the land on which tt Is filled up. The injunction granted conforms in terms to tho prayer of the complaint, and {8 accompanied by an order directing defendants to show cause on the 18th inst. why they should not be restrained perpetually to sho samo extent. James Milligan and Martin Dolan, aged respectively thirteen and nine, wero srraigned belore Recorder Hackett yesterday to answer to a joint indictment for burglary m the frst degree. The complatuant in the case was Mr. Edward Sackman, who keeps a jewelry store at No. 204 Hudson street, Ho testified that on the night of the 2d of August ho was asleep in a room adjoming his store when he was awakened by a noigo as of some one walking on the floor, Proceeding into his shop he found the smaller and younger of the prisoners behind the counter, and at once took him in custody, The elder boy, who was there watching out- sido (he door, was arrested laver, The smaller boy pleaded guilty, and said be was induced by his com- paniop, Milligan, to creep in through a hole in the shutter of the store. Harrison, jointly indicted for grand Jar- ceny with Frank Stewart, pleaded guilty and was re- manded till to-day for sentence. The prisonors called upon Solomon Weill, No, 22 Irving place, on the 7th inst., and Harrison represented that he wished to hire afurnished room. Ho was shown a room which he declared would suit, and paying ouc week’s rent was given a latch key. By means of,this he gained entrance to the house and carried off $521 worth of jeweiry and clothing. John Baker, a German without a nose, was con- vieted of having stabbed in the arm John Georgo Wese, who lives in the same house, No. 90 Sheritl street. Wese, who gathers rugs and bones for a living: stated that the accused used insulting language toward Mra. Wese, and thut when he rowonsirated Baker stabbed him. The stabber was sont to State Prison for two years, HOTEL THIEF. James McPherson, who hired a room at the hotel of John Winters, No. 1,009 Third avenue, and whe was caught soon after attempting to rob the room of the barkeeper, C, W. Buckley, was sent to State Prison for two and a baif years upon his pleading guilty.
