Jullus Solomon,—On calling the Jury for the trial of te above action counsel for one of ‘Che parties challenged the array for principal cause ‘upon the ground that Thomas Dunlap, who super- Yntended the drawing of the jury pancl, was not Com- missioner of Jurors, Judge McAdam, who presided, held that that question could not be inquired into or determined inany such collateral manner; that Mr. Dunlap was in possession of the office wader color ofa Jogal appointment, and was therefore an oflicer de facto, and that his acts in that capacity were as valid, )80 far as the public were concerned, as the sets of an officer de jure, and, as Judge Bronson remarked in an ms case, “ag the duties of the office must be discharged by some one for the bene- fit of the public the law does not require ‘third rsons at their peril to ascertain whether such officer has been properly elected or appointed be- fore they submit themselves to his authority or call ‘upon him to perform official acts which it is necessary should be performed.” Any other rule would lead to interminable confusion and perhaps conflict of docision in the various courts, ‘This principle hus beon applied to those acting in judicial as well as ministerial offices, and in cases where most important rights were depend- ing upon the result. The only way in which the title to office can properly be determined is by quo war- ranto by the people upon the relation of the one claim- ing the office against the person charged with usurping it, aud, even if that proceeding resulted favorably to the jaimant, still the acts of the officer de facto while in Possession of the office, pending the litigation, would, 80 far as the public are concerned, be perfectly legal. ‘These rules have long been settled and may almost be considered elementary and putat rest any such ques- tion ag the one now raised. ‘The objection must be everruled. ‘ THOMAS BARROW’S WILL. Some time since Mr. Thomas Barrow, a wealthy resident of Louisiana, removed from that State to New York, where he diod recently, Yesterday his will, containing three codicils, was filed it the office of the Surrogate of this county. His estate, valued at $8,000,000, has been divided by his will among his relatives and nearest friends and several public institu tions. The will is dated February 14, 1859, with codieils \dated May 11, 1800; June 9, 1808, and May 2, 1872. After providing ’munificentiy for his ‘relatives and ifriends the testator gives $5,000 to the New York Eye and Ear Infirmary, $5,000 to the New York Juvenile Asylum, $5,000 to the New York Association for Im- Proving tho Condition of the Poor, $5,000 to the American Female Guardian Society _ for tho Home of the Friendless, $10,000 to the New York Historical Society and $5,000 to the New Jersey Histori- cal Society. The original will bequeaths $10,000 to the Presbyterian church at Woodbridge, N. J., for a ublic cemetery and tho embellishment of the same; ut the second codicil of the will revokes that bequest on the ground that the said church has already pro- vided for itself a cometery, and instead of that bequest gives $50,000 for the erection of a public reading room and library in the town of Woodbridge, N. J., and for ‘supplying books, &c., to that institution, ‘executors named are John ©. Barrow, nephew; ‘William H. Neilson and Richard H. Bowne, of this city. THE ITALIAN COUNTERFEITERS, The two Italians, Giacomo Giuliotto and Antonio Cordono, arrested at the Grand Central dopot on Mon- day morning, charged with having in their possession counterfeit $10 notes on the First National Bank of (Philadelphia and the City National Bank: of Pough- ‘keepsie, with intent to pags the same, were brought be- ‘fore United States Commissioner Osborn yesterday for examination. United States Assistant Distrtct Attorne; Foster represented the government, Mr. William F. ‘Kintzing appeared for Giuliotto and Mr. Joseph J. jMinellt for Cordono. Captain Kennoch, of the Secret Service of the Trens- Department, in charge of the New York division testified that with the assistance of Officer McMahon, of the Nincteenth, sub-precinct, he arrested the accused at the said railway depot. ‘The prisoners, at the time ‘of arrest, wanted to know why they were arrested. eniaia Kennoch told them they were suspected of wing counterieit money in their possession, The ‘prisoners denied having any. At the Nineteenth sub- ‘precinct the prisoners were Searched by the two oflicers, In the presence of Sergeant Joseph Stewart, and abou ($800 in counterfeit motes on the above men- ‘tioned banks found upon them, concealed in the nu- amerous pockets in their clothing; about $500 in bad ‘money and $9 22 in genuine bills were found on Giuli- ‘otto, and about $300 in counterfeits and $9 05 in good money on Cordono. Louis Delomo, an Ttalian, who acted as interpreter r Captain Kennoch, testified that after the arrest ‘Gtuliotto told him that he had found the money which, he had when arrested while walking along Baxter street, and that Cordono had told him that he received the money found on bim from his employer in pay- ment of wages. Before Judgo Morgan, TRIER HELD FOR TRIAL, Justice Morgan sat on the bench at the above court yesterday, in place of Justice Otterbourg, who was in- disposed, The case of Ludwig L. Trier (not Trice), the clerk recently in the employ of Henry Cario, of No. 23 Union square, charged with embezzling $1,925 belonging to the latter, was yesterday called up for examination. ‘Mr. Price, counsel for the defendant, put his client on the stand. He stoutly denied the charge of embezzle- ment, and swore that the money had _ been stolen from+ him. His evidence was briefly this:—That be was riding down town on a car of the Bleecker street line with the money aforesaid in the pistol pocket of his pants; he was on the front platform, which was crowded at the time; upon arriving at the City Hail he missed the money; he looked around for a policeman, and, not sceing one, rushed to the Central Oftice, where he made a state ment similar to the above. It appeared from the testi. money of the prosecution that Trier had been fre- uently, requested by Mr, Orvis to bring the money to office until at last ho turned up with a story of aving been robbed. The Court held the prisoner to answer in deiault of $2,000 bail, WASHINGTON PLACE POLICE COURT. _ Before Judgo Wandell, SNEAK THIEY ARRESTED. Early yesterday morning a well-known sneak thief tamed Louis Edwards entered the rooms of Mary Mutherer, at No. 547 Hudson street, and stole a dréss and two coats, worth $50. The theft was witnessed by Morris Sharp, who pursued Edwards and, aided by an officer of tho Ninth precinct, succeeded in capturing bim. He was held in $1,000 bail to answer. ROBBING HIS MOTHER, Mrs. Eliza M. Madan, of No, 652 Second avenue, pro- ferred a charge of burglary against her son, Charles H. Madan. She accused him of breaking into her house, at the above number, and stealing a pocketbuok, contain- ing $8. Ho was arrested at ten o'clock yesterday morning, at pier 34 Nort® River, Charles was com- Jnitted 11 $1,000 bail to answer, ALLEGED EMBEZZLEMENT, Charles Murray was held for examination on a charge of embozzling $152 from Dodd’s Hxpress Company. Murray was employed by the company as a driver, and, it is alleged, he collected tho above atnount from a Mrs, Adams, of West Eighty-irst strect, and appropriated She samo to his own use, ESSEX. MARKET POLICE COURT. Before Judge Smith, T00 MUCH CONFIDENCE, A man named Frank Claus was arraigned at the abovo court yesterday on acharge of robbing Charles Gross, of No. 82 Stanton street, of $140 in money and a watch ‘pnd chain valued at $120, Claus, who is a barber, re- siding in New Jersey, was invited by Gross on Tuesday night to shure his bed, as it was too late for Claus to reach home. When Gross awoke yesterday morning he saw Claus going out of the house with his vest, contain- ing the above mentioned property. Judge Smith held | the prisoner in $1,500 bail to answer.
