10 —_—_—— THE GENEVA AWARD. ‘WaseiverTon, April 19, 1874, ‘Whe Bill for the Distribution of the Geneva Award. ‘The following is the full text of the bill reported from the House Committee on the Judiciary to — provide for the just and equitable distribution of j ‘the award made to the United States by the Com- | missioners at Geneva under the Treaty of Wash- ington :— Be it enacted by the Senate and House of Repre- sentatives of the United States of America, in Con- gress ase! |, that out of the money paid by | the government of Great Britain in satisiaction of the-award of the arbitration at Geneva, under the Treaty of Washington, indemnification to the United States and citizens thereof and corpora- ons organized under the laws thereot or the laws of tue several States and Territories therein, shall | wbe established aud paid from the Treasury, in the manner hereinaiter provided, to the following classes of claimants in the manner following :— Pirsi—For ali loss, destruction or damage by any Confederate cruiser ior whose acts the gov- ernment of the United States have made upon the ernment of Great Britain, done to or suffered y ali Such Corporations and citizens of the United States, actual owners of property at the time of Tts destruction, whether ships or cargoes, outit, advanced or other wages id to officers and sea men, or [reights actuaily carried. ‘To the officers and crews, being citizens afore- gaid, all the wages which had been actuaily earned ‘by tem up to the time o! their capture, loss or destruction in any vessel py such cruisers, to gether with the individual property of each re- spectively captured anid lost or destroyed in the vessel so captured, Wao have not received the in- and to such officers and crews, or to any person on board either of said vessels, an indemuity for damages aomally sustained from such captare or derention, | and the amount expendcd in returning to tneir homes, or the place where they engaged tn busi- mess or took employment, respectively, not includ- ‘wg any prospective proiitsy or wages not earned at the time of capture, which had been theretofore paid them. ‘Tu the United States, for all vessels the property ~@f the government, or which .were under charter to the United States, and lor the destruction or Joas of which the United States, by the terms of ‘the cnarter party, was liable, which were captured and destroyed and lost by said ernisers, together with the property of the United States on Doard, and the same indemnity to the officers and crew of said vessels, respectively, as herein- beicre provided in case Of capture ot private ves- nels, except Where such losers were insured in part or in whole for the property sv lost, In which “case the indemnity shall be made only for the loss beyond the sum received by the loser for such in- surance thereupo: surance. ‘Yo all insurers being citizens or corporations of the United states respectively, having insured or reinsured property 80 destroyed, who shail show, by an exhivit of their books of account and busti- mess or otherwise, that the War premiums actually Treceived by them did not equal in amount the Josses paid by them because of property thereal- terward cuptured and lost or destroyed by either or all of said cruisers; provided that the amount paid w any mutual insurance company Jor 10888 80 sustained shall be apportioned by the company among the Members thereo! at the time of tue losses paid by them respectiveiy, in propor- tion to the interest then owned by each member thereof; and provided further, that no imsurer shal! have any claim or right in the clatims of any assured hereim provided for because of any assign- ment, either in law or in fact, uniess snch assiguee had actually paid a jast and adequate considera- ton thereior other than underwriting the policy or settling or paying any loss claimed by tue as- sured.
