ALBANY, May 5, ‘1873. ‘The two heuses reassembled this evening-with & “quorum in each, most of the ‘countrymen being on hand good and early, thanks ‘to the “scare” given them on Friday night, when a call of the House ‘Was 80 convenient, The sensation about THR CHARTER “MUDDLE” created a good deal of gossip on all sides, but it ‘was generally conceded that Mayor Havemeyer is NEW YORK HERALD, TUESDAY, MAY 6, 1873—QUADRUPLE SHEET. L, on Sunday last, at two P, M., in no denger, inasmuch as the Dongan and Mont- gomery charters are not repealed by the new charter. The Montgomery ‘charter provides that “the Mayor shall hold office until bis successor shall be appointed and until he shall duly qualify.” The Dongan and Montgomery charters are the fin- damental law under which the eity was tncorpor- ated, and represént a law older'than the constitu- t4en of the country. VETOED, * ‘The Governor returned with his veto to-night ‘the bill to provide for the payment of the Clerk of ‘the Third Judicial District Court. It will be ob- ‘served that he bases his decision upen the opinion ‘of Comptrolier Green, and in this respect it will possibly affect a large number of other bills of somewhat similar import. The message, by re- ‘quest of Senator Murphy, was allowed to lie over until to-morrow. The following is the measage :— THE GOVERNOR'S MESSAGE, 3 return unapproved Senate bill No. 298 retattve to the salary ofthe Assistant Clerk of the Third Police Judicial Court of the city of New York, ae of the sal- ary legalized “by this bill had been by the, Comptroller of city of New fork. oT it him, the submitted 0 for purpors of ascertaining the grounds of his decision, and is letter is transmitted herewith, together with a paper containing memoranda relative thereto and a copy of the pay-rollot the appointees of said Court. troller's 0) the appointment Police Judicial Provides tha’ the noard of Sopervinges. shall create no ner offices, ex: by acts hers by the Legislature. His at the ‘authority of the e given thereafter to the creation of an; new office, and that chapter 254 of the Laws of 185 which ves to the police justices the power mt clerks or assistants, wi the ap- ot © Supervisors, is not such an act is meant by the above quoted passage. In order, therefore, to give the Supervisors the power to create & new office within the meaning of the act of 1869, the creation of the particular office should have been ex- Per authorized by a subsequent act. I have been formed that it was decided to appoint assistant clerks under chapter 264 of the Laws of 1554 If this be £0, and the cases are identical, the Comptroller's opinion is erroneous, and the Courts would, on the application of ‘the assistant clerk, issue a mandamus to compel the payment of hig silary. In such a case there, would Ye no need of the interposition of the Legislature Af the appointment was legally made, n ceived for seeking a confirmation of it. of the Comptroller and of the Attorney General, whom have consulted, that this bill would pewercase, the jee he holds It was created at a period ot gross abuse, when swarms of useless employes were thrust on the city in defiance of law. Ithas no claim to the consideration of the Legislature. It was Megally made, It has no need of legislative interposition if 1 with legal authority. Ideem it proper to add exercise of the legisiative power of the State seems to me too elevated and grave in its character to be inter- Pp |. It ig in view of this principle that I return a bill which I might not otherwise have consid- ered of sufficient importance to be objected to. JOHN A. DIX. The veto was laid on tne table on request of Senator Murphy. Mr. Herrick, of the Committee on Grievances, offered a resolution in the House to one At- ‘wood $750 for services as counsel to the commit- tee, and $4 a day tor the services of a clerk and a sum for the of a stenographer. It Jeaked out that the committee had not been empowered to employ anybody, and it was shown by Mr. Husted that the law of 1863 required a concurrent resolution to authorize any committee to employ counsel, &c, This effectually squelched the resolution, about the et of which it is said there will be some rich developments soon. COURTESY TO THE UNITED STATES SENATE COMMITTEE. Mr. Prince offered the following resolution, which ‘was adopted :— Resolved, if the Senate concur, That a joint committee be appointed, consisting of tive ‘members of the Senate una ten members of the Assembly, to meet the Committee of the Senate of the ‘United States on Transportation Routes to the Seaboard on its visit to the city of New York, and to present to the Sttention of that commiitee such facts as may appear proper regarding the transportation routes to the seaboard ithin or pardally within the State of New York, and generally to represent before said Senate committee the interests of this State, said joint committee to have farer fo act, after the adjournment of the Legisiature, jut without expense to the State. Mr. Wells, from the Committee on Trade and Manufactures, to whom was referred Mr. Wood's resolution tp investigate the affairs of the New York gas Companies, submitted a report that in view of the short time given them to make such investigatien, the time expiring to-day, it would be impossible to do the subject justice. | and therefore ask to be discharged from its turther consideration, Mr. Cleary, one of the committee, stated that he dissented trom the report, Mr. Weed said :—*'As Mr. Woods, who moved the inves- tigation, isabsent, Imove the report be laid on the table,” which was carried.
