THE LANAHAN TRIAL. THE INVESTIGATION BEGUN. Presentation of the Ca:e by tho Prosecution— Roply of the Decxce—Alieged False En- tries and Gross Discrepancies—Dr. Lanahan on the Stand, ‘The investigation of the charges preferred arvatnst Dr. Lauahan, assistanc agent of tie Mechodiss Book Concern, by Dr. Caritoa came up yesterday before the Book Commuitice aa Bishop Janes and Ames, Dr. Brooks, chairman of the committee, briefly stated tie recent proceedings d the present con- dition of this case, aul asked the parties Wf they Wore ready to proceed to trial. Being answered in the aMirmative, Dr, Caviton named his counsel—E, L, Fancher, General Runyon, Rev. tl, M. Pease, D. D., avd B.D. Rolph. Dr. Lauahan named his counsel—Judge Reynolds, tev. J. M. Buckley, C. W. Price of Phiiadelplia, Oliver Hoyt and Jona Elliot. < Mr, Fancher then stated the grouuds of tne prose. cution, the substance of tue charges aud the proof pertaining thereto. He recited the court proceed- ings of Dr. Lanuhan for a mandamus, whici Dr. Faucher declared were louuded on such assumptions Of autioriy that ii was deewed important to call the attention of tne Hook Comimitize to them Keaamg from Dr. Lanahan’s court app ion, counsel sald there wa ' SOMEVHING STARTLING IN THE PAPER to any vine who loves tie Church and the Book Con- cern. The assistaut azent appears in the case aa relator; and Thomas Carlton, oy namo, and the Book Concern, sre made respondents. This action nas been devised by Lanahan und bis counsel, with- out conference of any sort with the agentor any Member of tne Book Cows tiee, mm suck manner as to shock the conscience of tae Church, And these and further ailldavits ave secretly printed and given to the public p ore tie agent or any one Con. ected with tae Look Concern has seen them. shese aMdavits Dr, Faucher charged pr. Lanaia With fighting, quarrelling, brawhng, &e.—vrother golng to law with brother, which ts permitted by tho New Testament only in extreme cases by Church members. Lut livre the assistant agent of the Con- cern rushes into the secunr court and myokes the arm Of its power against his superior in ofice, The credit of the Book Couce:n and the peace of the Obureh are disturbed by suen litigation; tae money of the Concern is iiken to pay lawyers, and the clamors of the secular press aud of the ene. mies of the Church are tue necessary result, What peace and harmony cas exist between ageats when one is suiag another? And yet tere must be, else the lorge business of this Concern cannot be su Cossially prosecuted, Yhere 1s no evil so great as lawsuits in Methouist famities. And onc of the con- feyuences of this litt, on Is to reopen and keep Miive an old proceeding which has shaken the Chureh to its tonndations, but which bas had no basis, and It might and should have been settled m this olice, The grounds for tus proceeding asserted by the assistant agent are hostie m character to ' this Concern, Dr. Fencher ihen reed Lanahan’s ce afiidavit reciting the statute of Incorporation, tn Which himself and Dr. on are named as cor+ Porators of the book Concern, Dr. Fancher con tended that Dr. Lanahan utteriy ignored ch appointment and tands upon a statute of of the State of Ne and that this 1s a PROOF OF INSUFFICIENCY OF JUDGUENT or of temper which should imvoke the reprekension of the committee, Several clauses of those daviis were separately commented upon, and thas relating (0 Dr, Lauaian’s desire to as: ata from the books waether or not all the property of the Concern bad been turned over to the legally cons gtituled Corporators was characterized ag mon Btrous. Where 1s the man im the Methodtst Church, the counsel asked, except Joun Lanahan, who Would make such an isinuation? Here is an Appeal to Cesar to make a man honest who was honest before Lanaban knew anything avout bim. Can these tWo Men walk together who are no better agreed than this? and can the business of this Con- cern be thus transacted? ‘There ts no excuse for this proceeding. He (Lanahan) had never been tn- terfered with in his examination of the books of the Concern, but had them 10 his possession for tea weeks together, and, contrary to tue Instructions Of tals cormittee, pLiced them beyond the control of the agent or bookkeeper. He wakes pretence to this comuntitee that fio wanted the books for his de- Jence tn the Goodenough siander salt; but in his ap plication to the court ve takes alfogether different grounds, How could books which he het never seen make evidence for him in the Goodenonga suit? (he couusel asked, Dr. Fancher then qaoted trom the decision in a somewti nhar application by Dr. Lees, of Boston, to an Hugtsa cour, ia a case in which John B. Gouga sued Lees for slander. Baron Marca decided that such an application was: absurd and unheard of, and that the ibeller sho have obtained bis proor before atiering it, and promptly denied the application; and counsel con teuded Lanahan woatd fd no court here ready wo granthis, But Dr. Lauatan’s real mot counsel charged, is, on the authority of the State laws, YO RIDE ROUGHSHOD OVER THY BOOK COMMITTER, Use General Conterence oud tie agent and every- body tm the Concera: end fe bas asserted so mueh within the walls of this estabishiment. These are the things which the jMosecution in this case are ready to prove, and here they rest. Judge Reynolds, for the detence, asked for the Bpecifie indictments im tie case, for which Dr. Fancher rred hin ta Dr. Carilon's letter of May 25 to the commi'tee. Counsel on botn sites then agreed to the several printed documents, which they should consider as presented in evileuee wtih. out being read, and the committee. having fi upon the duration of is sessions, from (en A huli-pasi tour P.M. daily, took a recess v1 0 t Afternoon Session.
