Most Teaders will bave forgotten the Salient points of this remarkable case, which are partially ‘revived swy ie death of Mr. Earle, a man once prominent in business circles and moving in he first society of conservative New England. ‘Thomas Earle was married in 1849 to Ahce Chase, @f Seiem. Ton years of happiness were accorded to ‘the couple, who, to all appearances, were most Joving, And Itberally endowed with all the substan- tual and joxurions appotntments of life following ssuccess in business anu the accumulation of wealth. AFT THE BIRTH OF THE LAST CHILD, Thomas, Porn tn 1859, Mrs. Earle seems to have decome sebject toa strange halluctnation, showing Atself in # marked dis!ike for the soctety of her hus- ‘band, which became intensified through the tn- uence of SPIRITUAL DOCTRINES, ‘which taught her disordered imagination that a “way to soulfnl peace might be found in the society of a dark-haired ativity. Accordingly we find a mumber of compassionate gentlemen, of the kind always waiting round for chances of usefulness, visiting here and there, writing notes and prac- lising magnetism, while the husband is away at the war during the year 1861. In the suit for adultery that naturally follows as a sequence a social and “select crowd of high-toned and liberal-minded ladies and gentiemen are seen figuring on the car- pet, among whom MES. EARLE WAS PROMINENT, -as indicated by the evidence on the trial for adul- tery instituted by Mr. Karle in 1865. It was not re- ported or published at the ume, through the influ- ence of Mr. Earle. who desired to spare his wife the shame and his children the disgrace which he un- douvtedly had the power of tndicting. The MILK AND WATER PROSECUTION thus conducted gave ail the vantage to the woman, ‘Who used ner wealth and influence to avert the consequences of her delusion. From subse- quent developments no doubt remains that Rad the trial been a pubiic one justice ‘would have been influenced to a more impartial de- cision, Sometime previous to the trial of 1865 Mrs, Farle haa deserted ner husband and family and re- turned to her native piace, where she still reside: Belng possessed of about seventy-five thousand dol Jars ip her own right she had no, trouble in procar- ing friends to war upon her husband, who clearly gave her the advantage in accepting a divorce on any ground otner than that of adultery, which would have made all her future attempts to obtain posses- sion of the children fruitiess. AFTER THE DESERTION OF TIE MOTHER Mr. Earle procured an estunable lady to live in his family and care for the children. Becoming en- @eared to the children and consulting only their happiness Mr. Earle eventuaily married Miss Cole- mau, his housekeeper, shortly alter the decree of divorce was grantea for desertion, about two years Previous to this, however, Mr. Earle had spent @ year in Europe for bis heaith, during which Mrs, Farle had taken the children to Salem. THE NEARTLESSNESS OF THE DIVORCED WIFE and_ her advisers in refusing the dying man a sight of his childres on his deathbed, notwithstanding the assurances of the attending physician of his condition, stpplemented vy a refusal to permit their attendauce at the funeral in response to a courteous mote irom Mr. Earie’s brotuers, one of whom is Mayor of the city, is a theme of indignant comment 4n ali circles. Extension—An Injunc- tien Vacated. Before Justice Giibert. Wiliam H. Adams vs, J. Wyckoff Van Sickelan, John Ives and George W. Pa'mer.—By an act of the Legislature passed in 1962, and an amendment in 1870, authority was given to extend Atiantic avenue to the county line, of same with a8 in the city of | Brooklyn. Under these acts the defendants above named were appointed Commissioners to open, grade and pave tne extension, and aiso to estimate the damages to the owners of the land taken. The Jand has been taken, the damages estimated and the report of the Commissioners confirmed last De- cember, ‘The Commissioners proceeded to advertise for bids for the grading and paving. W. H. Adams, the pee above named, was the lowest bidder, and in February last the contract was awarded to him, Mr. Adams did aot comply with the turms of his con- tract in several important particulars, and in March Jast (he Commissioners gave lim notice that they had the contract prepared for execution, and that ne must execute dt by the 15th or they would consider that he refused to fulfil it. Mr. Adams did not ap- pear by the 15th, and the Commissioners conse- quently considered they were iree {rom any obliga- tions to him, Mr. Adams dtd not think so, however, and he commenced tits action against the Commissiouers in the Supreme Court of New York, at the same time (May 6), obtaming an injunction from Judge G. Barnard, preventing the Commisstoners from Qwarding the contract to any other person except himself, and also restraining Supervisor Schenck, of the town of New Lots, from paying any other contractor for dolug the work. Yesterday morning Justice Gilbert granted an order vacating the injunction, without prejudice to the plaintiffs right to make application for its renewal. KINGS COUNTY SURROGATE'S CouRT.
