ee NEW YORK HERALD, TUESDAY, JULY 20, 1869.,—TRIPLE SHEET. ses Se maiiuin renee ccs “PIT! Plat! Poaf!?=—Opern Bonffe—Restora- tion of Pinft%, Lager—Hew it was Done aud Why—More Selzures—A German Sent to the House of, Correction for Selling Lager. {From the Boston Post, pw gb The second grand sensation on was experienced Satur wierngony and in alt essential points it was so ded success, The = was known a few citement Was in a Major gone Jonés? aoputies had seized the well known days since that rer {rom ftessrs. on Franklin @ large stock ae i cota ah mene ot the ‘treet, and our German friends, a: Sell as our nave born prey who indulge in that harm- less compound, became much exercised thereat. For afew du “our beer saloons Were as dry as a vaitog on bird’s nest, and there was weeping and rai and gnashing of falk thrown in, The pow t be saw the com- ing Leyte eet began to iD took about to see how they Pipe teh avert the disaster to which they were roshing. Presently it was given out, how we lane never been able to find out, that hi might be induiged in, and our Teutonic fri were once more content, RETURN OF THE LAGER. pg were not prepared for the announce- ment that Major Jones te te orders for the re- turnof the lager seize sa ert 8, and the news fell upon the town “ike ‘@ peal of thunder from a clear sky. No Bove | has created sueh excitement for years. It was the forte of conversation in the streets, the hotels, cars, and more especially in the saloons ‘vere lager is the princi- pal commodity, People in scoves rushed to Franklin strect to see if it Was realy so, and when they beheid the big wagons of the firm unloading barrel after barrel direct from the Commonwealth's vaults they became convinced of its truth. Others, pro- hibitionists and members of the Alhance, made all speed to Major Jones’ headquarters to find out what itall meant. They saw the Chief Constable seated at his desk, a copy of the Post near by, and asked if it was true that he was restoring seized liquors—for the law says lager 19 tmtoxicating liquor—and he simply but DOE informed them that the report was correct. For be it Known that Major Jones, &. C., is always polive, whether mterviewed by ram- rods or liberals. They were amazed—it was some- thing the probability of which had never entered their minds, and they asked the simple question, “Why?? But the Major vouchsafed no answer, and departed with the firm belief that now, if never before, things are very much “mixed,” We concur, In fact, almost everybody concurs. WHY I? WAS BONE. Although the State Constable was very reticent, as usual, in giving information, the reasons for the restoration of the lager gradualiy leaked out. The Messrs. Pfam, however, were not backward tn giving their statement in regard to the case, which 18 That when the seizure was made the matier was imimedi- ately put in the hands of Mr. Augustus Russ, their attorney, with a view of Ae it before the courts, They give a3 their reasons for this that the liquor was brewed prior to the 14th of April last; that it was stamped with the United States stamps as required by law, and that a portion of 1t had heen sold to go out oF the 3 State, entire seizure, they clalm, was illegal. Quite a large amount, it will be remembered, Was confiscated (seventy-six barrels of Various sizes and avout 100 dozen bottles), aud be- fore the matter could be brought before the law courts the whole would perish. This lavter roy of the case, no doubt, hastened matters very much. doubtless Major Jones is averse to having the ‘dom. monweaith’s vaults filled with sour iawer, and ne- gotations were at once entered upen, with the re- sult already stated, the firm agreeing that if the law should decide the seizure Jegal a similhy amount of fresh brewed lager should be handed over to tie State Constable. WHAT THE RESULT WILL BE of course no one can tell. The matter is now with the courts; but it appears to be a pap Y weil set- vied fact that lager as a pi wt for the present. at least, sate, and can be dr y all those who have the necessary five cent apold (fs invest in its purchase, All through the afternoon and evening tie saloons were filled with customers. The inci- dents of the day were recited, discussed and com- inented upon, and a large egaanaly of lager was put away beyond the possibility of seizure. On one point all agreed, and W'that was that the ceputies in Making te seizure had “siopped over’ and that ws Chief had retreated from @ bad position m good order, THE RECORD. ‘That this view of the case was the correct one the following clearly shows:—Upon the records of the S'ate Constable, opposite the seizure made from Messrs, H, & J. Pad, the following words are writ- ten in red in) “This seizure was abandoned July 17 on the authority of @ written opinion from the Atiorney General.” MORE SEIZURES. The force during Saturday was not particularly aetve, and the day, on the whole, was much the same as the few preceding ones. -Deputy Gilman seized about twenty gaitons of ale and liquors from P.S. Witherell, Jr., Nos. 104 and 106 East Dover t, and on pete rg of Mary McHugh, No. 26 treet, aud Demis Donahoe, at No, 24 Plea- sant street, swall quantities were taken. Later in the day a posse made a‘raid on Ellen Desmond's house, No. 144-Purchase street, where they contis- cated two gallons of whiskey and thirty gallons of ale; they also took two gailons of ale from D. 'P. Wren, No. 9¥Parchase street, and that was van the ex- tent of the day’s work. A GERMAN SENT TO THRE HOUSE OF Cems oat in the Superior Court at Hast Cambridy Saiurday, Judge Pitman (jate President the Senate), £, OE named Nicola sentence a charge “Tiquor since Mm ‘artington,, committed be‘ore the preseut Ww tt Cag tnd effect, and con- fisted of Nhs wife's 8 lager beer to a few Ger- «ans in the vicinity, the oficer stated that he did pot think the man understood Che law fully, and that any person was to blame it was his wile. ‘The Judge thought it was a case which did not call Jor clemency, and he inposed the extreme sentence ofa fine of fifty dollars and three months m the House of Correction, and the man was taken from the court to prison, Faltorinl Comments of the Post. ‘The Post comments editorially as toliows upon the above:— The climax of absurdity in the political mantpula- tion of the Pronibuory law was reached on Satur- duy. Major Jones restored to Mr. Piatt the pro- a@igzious quantity of lager beer that was siezed a short ume since with such affectation of the pee or the law that me event was rendered almost Iie torical. Teain after team deposited tie liquid in the vaults from whence it was taken, while 9 delighted crowd expressed the utmost satisfaction by vie' cheering and drinking beer as fast as the actendal could dispense it, if this is not the climax of ab- surdity what can possibiy be? The Cle by which it is sald ego) Jones restores this beer, viz., that it might spoil before a legal decision could be rendered upon its seizure, is worthy & great legal mind, It 38 about a8 neat a “nedge’’ as was ever practised, and shows that the conference at tie State House, ‘and the trepidation concerning the political favare, have resuitea fn a determination to gave the German vote at all hazards, and to aliow a gross Violation of written law by permitting the sule of @ specifically prohibited article of trade, The lager drinkers, of course, are in ecstacies, and astute poli#cians chuckle at the shallow rase Which they hope will save them from the condemnation they have been dreading at the ballot box. But, we repeat, if the Germans and others are foolish enough to be hoodwinked by so Mtmay an attenrpt to conciliate theif good will, they are changed to a marvellous degree. If such shutting hypocrisy, such ross favoritism, such perversion and viola fon of he letter of the statute are not rebuked by the community, the jaws of the State are written in water, and the digniy and self-respect of Massa- chusetts have been frittered away by a few polit cians, who, dreading the effect of their blunders in Jegisiation, tts ond and bigotry, are now seeks tng shelver fh sponeibill'y by the most auda+ cious nullitig on ol fécor CHINESE AMUSEMENTS IN SAN FRANGISCO.
