‘ Tommencement of the Examination— Testimony of the Family Governess— The Alleged Intimacy of the Wife and Brother-in-Law—Domestic Scenes in Newtowa, L. 1, and Twenty-first Street, d&e., Kc. SUPERIOR COURT. Before Judge Garvin. Atthe hour appointed for the opening of the court yesterday morning (eleven o'clock) the large room where the trial proceeds was completely filed; but there was an absence of all crushing or crowding, such fas is generally witnessed on similar trials. The most perfect order was preserved. Two policemen were at each door, and no persons were admitted except the lawyers, Witnesses, reporters and other parties con- nected in some manner with the trial. The accommo- dations for the press were admirable, owing to the exer- tions and polite attentions of Mr. John Reid, one of the clerks of the court. Among the notable parties present yesterday were Mr. Peter R Strong, the plaintiff’, Lieutenant Colone! James HH. Strong, his brothor; Mr. Stevens, father of the @efendant; Mr, John Austin Stevens, Jr., her brother; Mr. Massey, an important witness, and two or thro Jadies occupying obscure positions among the spectators. At the opening of the court.one of the counsel for the @efenco called attention to certain inaccuracies in the reports of some of the daily papers, for the purpose, he mid, of warning the jury agaivet being influenced by them. ‘The Court, on hearing the matters referred to, stated that they were perfectly understood, both by itself and ‘the jary. A GOVERNESS ON THE STAND. Mr. Cram then called Miss Matilda Mussehl, the first ‘witness for the prosecution, who took her position in the witness Box, Mise Mussch! isa young and fair-looking German, dressed neatly, and speaking with a very slight Teutonic accent. She was, it appears, governess in the family of the Strongs during the times of the alleged adulteries charged in the complaint. Her testimony was ven in a tone so low as to bo scarcely audible, render- a it very difficult to catch what she said. After peng sworn she deposed as follows;—I know the plaintiff an defendant; knew the plamtiif since October, 1860; I ‘ommenced to reside in his family in October, 1860; I was ensaged as teacber to his little danghters; he was ‘then residing in the country, near Newtown, Long the house belonged to his mother; I continued in the family as governess until 1362; I saw Mr. Edward Strong as the house in Newtown; when I first went there I noticod Mrs. Strong and Mr, Edward Strong very much together; they were together almost continually; during thearhole wum:nor they sed to walk out together as much as they could; they rode togather on horseback and in carriage; they also went out sleighing together, and sometimes stayed out three or four hours at a time; they used to ride out together very often; Mr. Xdward Strong did not go very often to’ town; Mr, Peter Strong was in the habit of going to town every ‘day of the week; from October, 1860, I lived at Newtown ‘antil the summer of 1861, and then went for one or two months to Lenox, usetts; after returning from enox I went again to Newtown, and thence to the house in Twenty-lirst street; it was in the fall of 1961 that they (Mr. and Mrs. Strong) went to the house in Twonty-lirst street; they kept house there; the number of the house was 60; Mr. Edward Strong resided at New- town during the whole period of our stay there. Mr. Cram here offered in evidence a diagram, purport- to be an accurate sketch of the number and lo- eation of the rooms of the country house in Newtown; he desired to hand it to the witness, with a view to as- eertain whether or not it was a truthful diagram. Mr. McKeon objected, unless the witness had prepared tho diagram herself. Judge Garvin decided to allow the diagram, subject to ‘the exception of Mr. McKeon. ‘The witness then took the diagram, and at considerable Jength pointed out the various rooms, etating their rela- Live location, by whom they were occupied and for what purposes. It appeared from her testimony that the occu- pants were Mr, and Mrs. rong, Strong (mother of plaintiff), Mr. Edward Strong, James Henry Strong, the witness, vote oth and servanta The first ffeor was devoted Maa be purposes of a drating room, e second floor ‘with the exception that I think story, an attic one, above; I do not now who occupied that story, or Shether it was occu. pred at all; I don’t know that I was ever in it; tho rooms 5 the first floor wero devoted to the purposes of a front parior, a back parlor, a library and ‘dining room; on the wecond floor the large front room was used as Mr, and Mrs. Strong's bedroom; the little room adjoining was ‘sod as a dressing room for Mr. Strong; the room next in the rear of the latter was the children’s bedroom, and ‘the noxt in the rear was the nursery; on the third story ‘he large front room was a spare tedroom; the room on ‘he front end of the hall was used as a bed or dressing Yoom ; the large room in the rear was my own bedroom ‘and teaching room. kr. Cram—Did you ever see the defendant coming out ef Edward's room at Newtownt Mr. McKeon objected to the question as being leading, and said the proper mode was to ask the witness to state what she saw in the honse. Judge Garvin—The question is rather lending. * Mr, Cram said he bad no desire to lead the witness, Dut found it very dificult to get along if objections were eonstantly | rged. Under the instructions of the Court the witness was asked to state matters which sho saw herself and not what she might merely have heard. Witns one occasion I saw Mrs, Strong poet out of Mr, Edward’s room in the house at Newtowi ‘cannot say I saw her do #0 more than onte; I know her to be there often; I first knew of her being in the room from the very beginning of my being there; I can't re- member the last time I saw her in his room at New- town; I think we left Newtown in the summer of 1861; : saw this going on all the time I was in Newtown; when fen th ber leave the room she looked very * much j, she was flushed and excited; I remember see- a er ‘eave the room once, and knew her to be in there three hours on another occasion; on that occasion I papier — whether Mr, Peter St was in the ee Gounsel for Defendant—I o! entirely patio Witness—I heard Mra down stairs room was qveur very Beward had Seba 5 eee Re went while at walk out y tase ‘what the ward; the wait Berong about Strong rom, ‘8 and ould not find then to next story Wo wee if Mr. is room; his door was open and I called no answer, 80 I walked in and did not soe bi going down I went to my ewn room, and found it locked; I went down stairs and told the waiter! could not find either Mra, or Edward; on going up again I found Mra.
