THE SUSDAY TRAVELLING QUESTION. The Phuisdelphia City Raltroad Cars Stop- ped by the Mayor and Poilce. The city of Paiiadelphia is all excitement owing to the Bonday travelling question, and the matter is beginning to wear agerlous appearance. Tho clergy are preach- ‘wg against it, and the Mayor and police haye put a stop 40 tho running of the cars. On Saturday Inst the Soard of Directors of the Green and Coates Streets Passenger Rail- way held a meeting to determine on the course to be pur- eved in relation to travelling on Sunday. The following letter from bis Honor the Mayor was read:— Ovvick OF THE Mayor ov THB City OF PHILADELPHIA, July 16, 1859. ‘To THe PRESIDENT AND DIRECTORS OF THE GRKEKN AND COATES SYKEETS PHILADELPHIA PASSENGER RAILWAY ComPANy, Gunrixmen—Cow plaint hus been made defore me in be- Balt of the congregation of the Green street Methodist Epweopal charch, located in Green street, above Teath, ‘Uhat op Sunday last their religious observances were dis: turbea by the moving of the cara on your passenger rai!- way, end that a like annoyance is anticipated on tae com ing Sunday. ‘tne arrest of one of the drivers of your cars on last Rondsy, when the allcgation that the driving and rua- ning of @ railway car on that day was, under the cir- cumstances of the case, a breach of the peace, took piace ‘on the reagonable expectation that the legality of Fon arrest‘would be forthwith submitted for judicial deter- mination, which has not, however, beea dove. The Supreme Court of Pennsylvania, ia their exposition @i the act of Assembly of 1794, have decided that the ropning of public conveyances on Sanday is thereby for- bidden, (10 Harris 113, Jobngon vs. the Commonwealth ) The Court of Quarter Sessions for the county of Phila. de)phia, in the construction of the eame act, bave adjuged ‘thet “the worldly business prohibited by that statute may be carried on without disturbing a neighbor, or ia any wey attracting public notice; end in such cases, althougn the law is violated anc its penalty may bs exforced, no Dreach of she peace nor disorderly conduct can be charged upon the offender; but if the business traneacted be of wuch @ character as to disturb the quiet of the neighbor- , oF of an individual neighbor, or be carried on in we vicinity of a place of worship so as to disturb those nszembied for religious purposes, it would be a misde- meanor aud a breach of the public peace.” (1 Pail. Rep. of Leg. Int. 460. The Commonwealth vs. Teaman ) My duty is to cbforce the laws of the commonwealth ee they have been expounded by its judiciary. I chereiore ask of you ag law abidiog citizous that you refrain from apy ettemp’ to run the cars of your company ov Sunday, until the same shall be sanctioned by the de- cision of the Proper tribunal. Very respectfully, ALEXANDER HENRY, Mayor of Philadelphia. Some discussion arose on the matier, and it was fiaally determined thatthe carg should not commence ranning ‘until one o’ciock im the day, and that after that hour they ehould commence running from Oak street to Fairmount. ‘The following circular was also distributed among the em- ploy és of the road:— fo THE SUPERINTSNDENTS, CONDUCTORS AND DRIVERS OF THE GREEN AND COATES STREEIS PHILADELPHIA PasseNGER Rattway Comrasy:— The Board of Directorg,on the applicatioa of a very large number of citizens reeiding on Green and Orates as ‘well as other streets of the city, having determined to Tun & portion of (neir cars on the Groen aad Cortes street brench of their road on Sunday, during @ part of the day, i ie hereby strictly enjomed— 1. That tbe drivers eba!! not pres any church or piace of ‘worebip at a gait faster than a waik, and thas etrict care thould be taken by both conductors aad drivers not to in- ‘errupt or cisturb in any way the congregations or mem- bere thereof worshipping {n such places, 2. The conductors shail pot permit any disorderly or intoxicated person to enter the cara, nor allow any noire or distarbauce of apy kind. BY ORDER OF THE BOARD. Pursuant to this notice the Green and Coates Streets Company siarted a car from their depot, at Fairmount, ebout one o'clock, when the policemen faterfored and promptly arreeved the driver and conductor. Tne second car started a short time afterwards, and was aieo swpped by the police. The superintendent then made his ap pearance and agreed to discontinue the running. The ar- rested partics were taken before Alderman Hatchinsoa, snd heid for a bearing at eleven o'clock on Monday. The following is the letter gent by Mr. James Cooper to the Mayor, in reply to the letter of the latter:— JuLy 16, 1859. ‘To mm HonoravL8 ALEXANDER HENRY, Mayor OF THz CITY oy PRULADELPHIA: Dear siz—Your communication, bearing date of the ‘bth inet, informing me that complaint had been made «jn behalf of the congregation of tho Green street Motto. dist Episcopal church, located in Green, above Tanth treet, that on Sunday last, their religious disturbances ‘were disturbed by the running of the running of the cars of the Green and Coates Street Philadelphia Passenger Railway, and that a like annoyance is anticipated on the coming Sunday,” was duly received and reepectfully con- aidered, Your communication likewise states that the arrest of ‘one of the drivers in the employment of the company was wade on the ground that the running of @ ratiway car on Sunday “was, under the circurstances of the cage, a breach of the peace.” I have been instructed by we Board of Directors to say,in reply to your communica- Vion, that in rupning ® portion of their cars on oue branch of their road, on Sunday last, nothing was further from their intention than to disturd tho congregations having eburches or places of worghip on the route of their road, ‘or to commit a breach of the peace. On the contrary, it was enjoined on the superintendents, conductors and drivers that the cars of the company should not pass any burch or place of worsbip faster than a walk, aad that strict care shouid be taken not to interrupt or "disturb in ‘any way the congregations worshipping in such places. Jt was aleo evjoined upon them not to make or permit noise or dieturbance of any kind, and since then, written instructions to that effect have been placed in the hands of each driver and conductor, and put up in every car. [have tilzo been directed by the Bourd to say, further, that while ‘tbey have been instructed by their counsel, that the orderly and peaceab'e running of their carson Sunday is not a ‘Preach of the peace, they aro neverthelcss disposed, Mnrough respect for you personally, a8 well ag Obiet Mag: strate of the city, to defer to suggestions, cuatained ja your letter, so far as not to permit their cars to be run, unt after the expiration of the morning service in the several churches. The Board algo desire that I should avail myself of the opportunity which the reply to your communication affords to state, that they would regret to do any act at ‘variance with the views of any largeand reepectable class of their feliow citizens, except at the call of what they Eupposed to comprise a vast majority of the public. The Board has no wish and no intention to disturb the public Peace, nor to do anything that would be likely to prove subversive of the public morals. On the contrary, while they aro tho advocates of to'e- ration, they are at the same as much the friends of public order, ‘sound morality and enlightened Christianity as any of the few who have denounced them. Thanking you for the disposition you bave evinced to diecharge the duties of your office with courtesy, I beg leave to subscribe mynelf, yours reg city AMES COOPER, President Groen and Coates Streets Railroad Co, On the hearing of the case on Monday, one of the polica tostifled that the people in the car were orderly and quiet; ‘4 no bells on the horses; Iheard no more noise than there was a large crowd; I can’t say what col- lected the crowd; there was no rioting; tho act of running wos against the ordinance of the Sunday law; I heard no quarreiling. Mr, Hirst ingisted that the witness should state what the conductor was doing which constituted a breach of tne peace. Tho witness replied that “it was a violation of the orainance.”” Anote from Mayor Henry was exhibited, which in- structed the Chief of Police to La ‘ent the passage of cars through the bails up portions of the city, as such running fe necessarily a breach of the 16 peace. Sergeant Orr, having been ‘sworn, testified as foliowe:— I directed the arrest of the conductor of tho first car yesterday; I was standing in front of the drst car, before the horses; a gentleman made his apy nce on the front plaiform and gaid ho would like to eee the man who would arrest him; I told him I would arrest him; he said he was tho conductor; this was at Twenty second and Coates etrects; the car was stopped at the time; I was one of ihe pergons who stopped the car; the driver went away like a gentleman; the conductor wanted to 800 my war- rant; I told him one was not necessary; he was the only men in the employ of the company who was not orderly fo far as I saw; theo wero nobel 08 the horses; there were two belie, pers, on the tongue. Early in the day lerge numbers of persons a+sembied to take the Green and Coates streets oa bat two cars only had started out when the drivere were arrested for a broach of the pesce. This action ¢x.ited the indignation of the crowd, and a@ real breach of the peace would have oc- curred but for the prudence and forbearance of the com- papy. The ppecle assembled told ove of the directors to say the word, and the cars should run in eplte of the forts to stop them; but, acting for the company, the di- rector to!d them that they would gudmit, as good citizens, to the authorities, but would teet the legality of the acts of the Mayor aud bis police. This quieted the crowd, but by no means diminiched the feeling, and the Mayor’s action was very strongly condemned. The whole question of the right of the public in this matter will come up now before the Supreme Court, and we hope that on will leave no point of ‘t left in ambiguity or doubt. It is a or tion affecting the civil rights of @ large part of the po, tion of cities, and they wish to know whether the ald their civil rights on the game terms of equality under ex- isting laws as other citizene do. If they do, then there should be uo interferense on any pretext with the enjoy ment of them. If not, the fault must be in the existing lawe; and the public opinion which makes laws can have them jest what they want them, and what, under our constitution, they should be—equal ia their action upon «ll classes of the community and oppreseive to none. A BERMON ON THE QUESTION. An immense concourse of people assembled at the church of Rey. Jona Chambers, on Sunday sf{ternooa, to Viaten to @ eermon ageinst Sunday travel. ‘The sp: said the subject for their consideration might be aaid to be whether the city railroad corporations had aright to veto the laws of Jehovah. He had great respect for the editors ahd conductors of the secular prees of our city, yet he thought they showed a lamentabie deficiency ia Biblical lore by the way in which they bad recently spoken of the Sabbath. The Sunday papers were denounced in the strongest terms, a8 being the most scandalous sheets, and their proprietors ag the enemies of the Sabbath and reli- gion. The friends of the Sunday travel movement had based their argument in its favor on the ground that it was necessary for the benefit of the poorer classes, who could by this means cbtan the freeh air, and thus recruit their strength after the inbors of the week. He would suggest to these philantnropists the propriety of running their cars from six to nine o’clock on throe evenings of the week at aif price for the beneilt of there poor men, and by this menus the desired and could be sccompilehod capitalists wanted to do eomething to tion, let them balld houses in suse localgies and in such a manner ag would furnish them wi'h the comforts en- joyed by the richer clasees, and rent them at a rate which Would pay them six per cent, instead of fllen per cent, which was now the case in many ingiances. He felt proud of our city, which deservedly had the re- putation of being one of the faett in tho world, The members of the Continental Congress, tho framers of the copetitution, and the immortal Wasuiogwn took the Bible for their guide, and all respected the Sabbath. The speaker deplored the tendency of the times to tho dese- cration of the Sabbath and the increase of intemperance in our city, LETTERS TRAVELLING ON SUNDAY. A gentleman at Princeion, in this State, addressed a lotter to the Postmaster General to know if a letter mailed on Saturdey couid be allowed to stop over Sunday by ad- Greesing tho requeet on the envelope to a postmaster. He has received the following answer:— June 29, 1859. Sim—In answer to your note of the 28th ‘instant, I have tO inform you thet if a letier is placed in the post oflice with the direction upon it,/*T0 le ove? on the Sabbath,” the postmaster at the mail- ing cfilce would no*doubt respect such direction; but the letter being once posted, under envelope, to its aderess, would not again be seen until it arrived at its destination (except when obliged to paas through a distri- bution ‘flees, ‘and, of course, any such direction would bs of uo avail,’ At distribution offlces, where the mails hayeto be bandied generally with great despatch, it is very doubtful whether such direction would be regarded, although if not Uren it would be proper for the post- master toobey lem, Veopexiinily, your obedient ser van! HORATIO KING, To ———, Princeton, N. J. The gentleman who fought the information, explaing his reagons as follows, in the Presbyteriane:— Such a case as this sometimes oocurs: On Saturday morning @ man wishes to send off a letter on a two days’ journey. It perpYexes him to think that one of these days will be Sunday. This letter is too decidediy a representa. tive of himself, and to analagous to a servant or agent, for him to feel no concern at its journeying oa the Lord's day. Or, at least, his letter will add too much of a frac- tion to a mass of letters which in Iegielative minds ron. ders the Sunday mails a necessary institution. At the fame time he cannot weil wait and let it travel ou Mon- day and Tuesday. He will be satisfied if {3 travels on Saturday and Monday, and rests somewhere on Sunday, TuE ATLANTIC AND THE MEDITERRANEAN.—The Bay of Biscay and the Mediterranean aré to be united, and 1,200 miles to be saved, by s great canal through the isterior of Spain. Startling as this announcement may be at first to our readers, it is nevertheless true. The project bas received the sanction of the government of Spain, and the Queen, by her royal proclamatioa of March 28, 1859, has granted to its projector, Mr. Charles Boyd, of Barnes, Surrey, two years to make the neces- rary preparations for carrying it into effect. This gigan- tic” work, which ig designed for the purpose of shortening the passage of shipping to and from the Mediterranean and the ports of Northera Eu- rope by more than 1,060 miles, will be 285 miles in length, 840 fect wide and 30 fect deep—availa- bie for vessels of the largest and most unprecedented di- oe m will commence at Bilbao, on the coast of Biscay, and, proceeding through tho Cantabrian moun- faiba ead the oniley of Ebro, and passing by Saragossa aod Fatella, will fall into the Mediterranean at the Bay of Alfaques, in Catalonia. The cost of this enterprise hag not yet beem ascertained, but it is almost certain that a large portion of the expenses will be borne by the Spa- nish government, and 0! ently a ‘OOM paratively small amount of Capital will bo raised in England, while the revenues arising trom the tolls upon shipping and for right of way will be immense.—London Illustrated News.
