This was an action to recover damages for the non-fulfilment of a contract made by the defendants to deliver a certain quantity of sugar tothe Plaintifis, but which it is alleged they faiied todo. The damages are eid at $22,750, being the amount of the dif- ference between the market yalue of the suger ard the contract price of it as agreed upon between the parties, The complaint sets forth that the defendants (who were mercbants in Boston) desired to effect a sa'e of about seven bondrea tons of sugar, which they then (1856) bad at sea on board the ship Appa Kimball, bound for New York trom the Muvilla Islands; that brokers were employed to make such eaje, and that the plaintiffs did agree with the brokers to purcbase the cargo of sugar at gix conte and seven-cights of w cont per pound, four per cent to be de- dusted fer cash, the sugar to be delivered in August of that year at the foot of Coariton street, in this city.
