The prisoner presented tho check at the store of Andrew Martin, 72 Catherine atrect, and anid his employer wished to itcasbed. Before Recordor Barnard, ‘The first case disposed of in this court yesterday was an indictment for burglary in the firet degree, found aguiast Jobu Marphy, for breaking into the dwelling house of Patrick Flapnigan, 139 First avenue, on the night of the Siet of March. As the prosecution could not clearly prove the commission of the burglary, the prisoner was allowed to plead guilty to polit larceny. The Recorder sent bim to the penitentiary for elx months, and ordered him to pay a fine of $100, Levi Taman, charged with stealing $150 worth of berbs from the store of George H. Coolidge, pleaded guilty to petit larceny, and at tho request of the prosecutor (who did not want him punished) the Court was exceed- ingly lenient, sending him only thirty days to the city prison. Jeremiah Donovan, who, it is alleged, committed a vio- lent ageauit and on Peter Denning, on the 13th of March, pleaded guilty, and was remanded till Saturday for sentence. .The affray took place at Mat. Gooderson's, in Chatham street, AN EXTENSIVE. BURGLARY. James Donahue, a respectadle looking young man, was then placed on trial, jomtly charged with a man named Jobneon with burglary in the third degree, It appeared {rom the evidence adduced by the prosecution, that on the night cf the 13th of March the store of Frost & Cuehman was burglartously extered, and 2,800 yarda of ponges silk, valued at $2,300 was stolen; that from certain Toformetion received by the police, they went to a house in East Twenty seventh etreet, which they found hat been hired by the prisoner, who paid a month’s rent and took the key, at the katne trme stating to the woman that part of the furniture of bimvelf and friends would come in boxea; thet a few days after the burgiary the property was removed to this houre, where the prisoner was arrestol, and on being searched the key of the door was tound on big person.
