That whencver any of the owners of any euch Innde, tenements and hereditaments so taken shail be in- fants or otherwige legally incompetent in law te act, or abeont from the city of New York, the said Mayor, Alder- men and Commonalty may pay thé sums mentioned in the report or award as coming to such owners respectively into the said Supreme Court, to be secured, disposed ih and improved as the said Court shall direct, and such payment shall be equally valid and effectual ‘as if such owner or owners had been present and legally quatidied to act. In the matter of the County Treasurer of Dutchess County. — Ordered that the said County Treasurer show cause, on the first day of the next General Term, why an attachment should ‘not issue against him for refusing o: neglecting to comply"With the rules of the Court, and render an account of the funds and investments under his charge: a copy of this order to be served upon said treasurer by the District Attorney of Dutchess county thirty days before eaid term. It will be seen that the judgment rendered in the case of James Gallagher has been reversed. The pri- soner was tried for the murder of Hugh Kelly, in ‘tho Kivgs county Court of Oyer and Terminer, in November, 1857, and Convicted of the offence. He was thereupon sentenced by Judge Davies tobe hung. A new trial waa applied for on the ground that the killing wag done in an allray in which several were engaged, that it was not dis- ti shown that the accused was the one who had stabbed deceased, and that if it was done by him, it was doue in the heat of passion, without itent to take life, and the verdict should have been manslaughier in some degree instead of the greater offence.
