DECISION IN THE CASE OF WOOD, EDDY & CO. The decision on the motion of the Distriot Attorney to have the papers in the case of Wood, Eddy & Co. sent ‘ack to the General Sessions, was rendered yesterday by ‘the Justices of that court, It will bo remembered that Judge Russell held the defendants to answer for vending lottery policies, and sent the papers to the Grand Jury. But the prosecuting officer deemed it prudent to send them first to the Special Sessions, for some reason best known to himself, The following is the decision of the majority of the Justices, which was delivered by Justice Quackenbush :— ‘The Court are of the opinion that the act of 1855 gives to the Court full power to return to the General Sessions any case brought before it for tial, whenever circumstances sball make it appoar that such action would conduce to the public welfare. It is the duty of the District Attorney to Sppear and progecute all porsous charged with crime, either felonies or misdemeanors; and in this case he ap: ears and movos to have tho case returned to the General ceions, and urges several reasons, and among others, ‘want of time in this court to give the ‘matter the attention which its importance demands, Further, I am in dividually of the opinion that it is not in the province of the Court to inquire as to the public prosecu- wor’s motives in making such a motion, prosuming that it was made in good faith and for justifiable ends, and do not fee! warranted in denying the motion.
