During the summer time this might be borne patiently, although even then a seat would be an accommodation to females, children, aged or invalid men; but now, when winter has come, with its frosts, Storms, snowy strects and icy winds, it is disgraceful to the railroad companies that they have made no provision for their patrons, whom chance, business, or perhaps the sickness of friends, have compelled W use their cars ata late hour of night. Any one who has been compelied to Wait at the corner of Vesey street, after midnight, for an Fighth avenue car (of which only three are uv ou the whole line after that time), will understand the suffering weak women and sick mon are often compoiled to undergo, with no shelter and pot even a seat to rest upon, on these cold stormy nights. You will see that on the subject of these laws the ‘course of the Executive Department has been uniform. No President has over forgotten that solemn injunction of the constitu- tion, “Take care that the laws be faithfully executed,’” ‘The judicial department of the government has never swerved from the doctrines it has inculcated, nor shrunk from the reaponsibilities of their high office. Through the jong series enumerated, what good can be found, as de- rived either Wo the persons enlisted in the expeditions or to those who bave directed and controlled them? Whata frightful waste of life, reputation and treasure has there not beent In how many instances have they not dis- turbed the foreign relations of this country and embar- rusted the operations ef our government! It does seem to me that it is the solomn and sacred auty of the people of this country to frown inaignantly upon ai attempt that may be made to violate these laws, either in letter or im spirit. ‘The observations T have made in respect to the sixth Section of the act of 1818 will apply as well to tho expe. dition that went from this port in 1857 as to that to which the President's proclamation reiates, ‘The criminal laws of the United States also extend to the Protection of property in American vessels on the high ‘seas, and to propeety in the mail of the United States. There are cases in the court, arising under the acts of Congreés upon these titles, that’may roquire your atten tion. The District Attorney wili advise with you upon that subject Tnow close what I have to say upon the criminal laws of the United States. When I convened the special session of thiscourt my purpose was simply to dispose of such business as might be ready for trial, and which I could properly despatch under ‘the act’ of Congress al wing the court. The recent pestilence, I know, must have deranged the regular order of business in this city, and J did not wish to subject any party to surprise or in: convenience. The time for the regular sossion of the court was nigh, and there was no reason, should public business arise,'why I should not return and employ the whole winter in this court. If I find that to be my duty, that course will certainly be adopted. * * The mandate in the constitution to the President, to take care that the laws be faithfully executed, does not create a wall of separation between him and other officers and i”. Every one of us who participates in the proteo- tion and blessing of the constitution is under the highest Obligation in his sphere of duty to take care to observe faithfully the laws made according to that constitution. And when the President appeals to me or to you to give him our hearty co-operation in tho performance of the duties of his high office, we cannot, without forfeiting our claims to the respect and estimation that belong to a good citizen, refuse his appeal.
