The news he brought was unimportant. General Johnston was anxiously waiting for the arrival of Captain Marcy. The health of the army was remarkably good. Provisions were becoming scarce, but supplies were expected from Fort Laramie. Mr. Mason wes detained sevonweon days on account of snow storms: He met Colonel Hoffman's command one hundred and forty miles beyond Fort Kearney. Twelve hundred troops have arrived here within the last three days, a great proportion of whom proceeded im- mediately on to Loayonworth. Tho Repudiican's correspondent at Leavenworth notices rumor trom Camp Scot; that Captain Marcy cannot ro. inforce Got ral Johnston until the end of June. The Mepub- lican discredits this editorially, and states thet Captain Marcy would not be detained more than ten days, waiting the reinforcements ordered by General Garland, and that he would then be in a condition to marcb to Camp Seo't in forty days. Several Sauta Fe merchants arrived hore on Saturday, but thoy brought no news of importance. They suffered terribly from heavy storms and cold weather, anda great number of the animals attached to each train perished. All the streams were high, and water covered the plains. The Indians whom thay met reported the bee of nesriy all thoir animals by extreme cold. VETO OF THA PAID FIR DSPARTMENT ORDINANCE-~ ORDINANCE IN RELATION TO LIG@NSING ROW AND Sail BOATS— THR TWRLFTH WAGD BLECTION. Ata meeting of the Commgs Council Isat evening the following veto to the paid Fire Department ordinance, passed by the Common Council on the 2lat of April, was received from the Mayor :— Mayor's Ovvicr, Brooxurn, May 10, 1853. GeyTieMEN--Ihsve carefoliy considered the ordinance recently adopted by your bonorable body for the re-orgaa- ization of the te department of tne city of Brooklyn, and arrived at the conclusion that the Common Council do not poosees the power, under existing laws, to pass an ordipamce which in effect would disband tne presentorgsn It will be voen by reference te sub division 3, sec 13, Utle 2, of the city charter, that the power is granted Ssartod sp pies nasi cad ry fad tire doy y; Scie nat onteae the duties aud powers of fremen and police, The power to define and regulate the duties Of poilce are well aware has been taken from tne Common Council by the Metropolitan Police act. and it ‘will be found upon examipation of even the charter itself that the powers of the Common Council are within certain limits. In titie 7, eection 1, the precise mode of organizing the fire department is clearly set forth. Iteaye=m ‘The fre department of the olty shall be divided Into two and ove for the Raster dice. * tai And furthor on, in the samo section, it reads:— ‘The fire di iment of the city of Brooklyn sa at present on uted shell, with ft additives, form the orgaulzation fur wi real eastern district and the fire deoartment of the city of fullymeburg aa at present conatgiced shell, with ita al ous, ferm tae organization for (ue 1 ctr st Tt will be geen from the above quotation that the fire deparunents now existing in this ciry are established by Jaw and are as incapable of being abolished vy any ordi- nance of the Common Council as is any other branch of J the government Section 4 of the same title provides: tbat “for incapacity, negiect of uty an’ gross misoon duct, the Common ii may disband any ov! sais co panics, suspend or expel individual mombors thoresf, in the manner and witb the restrictions bereinafter provided for the remcval of officors of tue city government” Tae above, ao far as [have discovered, aro the powors of the Common Couvell over the organization of the fire depart ment, except that in section 3 of Utle 7 the foilo wing sea- tence cocurs:— ‘They shel! bave power to organize fire, hook and ladder, bose, bucket und vxe companies, and to organize the present fire depurimenti{they (hink proper. In the foregoing quotation trom the charter I fail to find sufficient power in the Common Council to aboliah tho Present system; and when we como to consider tne subse- juent action of the Legislature establishing tne office of commissioners, we find that much of the power pos- weeaed by the Common Council under the charter bas been teken from them and vested in tho fro commissioners. In the act of February 17, 1857, for the bower regulation of the fire department of the city of Brooklya, aud the act of April 17, 1867, to incorporate the fire department of the Eastern district of toe city of Brooklyn, after providing for the election cf commissioners the reepective districte, and prevoribing taeir duties, the fol- lowing section wil be found, which in language and subd- stance is the eame in both acts:— ‘The said commirsioners shell bave pulitegtine aut gee a cures See ‘of any tate ur city laws respecting the city of Brookiyn. Again, the same act deciaree:. tal! shall be, the duty of the 4 commissioners to inquire 10 leations for the organiza anion, and the ‘fesult of such inquiry, wbether ia {vor or aga application aball be certified py Sem Sroce> the Chie€ eat ciate organised unteen approved: by said fire oni unl caminisg ers, as provided for hereinafier mn soction Us. The conclusion seems to me t be inevite- ble, after examining the various acts of Legislature in reference to the fire dopartm of the city, that the Common Council, in the adoption of consideration, on, exceeded their ag ‘adopted: — See 8. No person shall own, keep or let, for pleasure , any small sail or row to be used on the lars for eech day 20 own, keep or without said license or painted number. Also to add to section 3 of titie 1 of the same chapter the follow ing —~ For each amall rail or row boat, owned, kept or lot for pleasdre or profit, @fty cents.
