Net a word about the President! Mas. Gaines’ Case.—You appear to me to labor under a mistake in regard to the late decision in the Gaines case. The Court below decreed that no will ean be proved without producing the paper pur- porting to be the instrument. The Superior Court reversed that decision, and deciared that a will that is proved to have had existence, and to bave been or destroyed, may be proved. Now, before such bate can be received, it must be made to aj pear the Court below that the will of Daniel Clar existence, and was lost or destroyed.
