NEW YORK HERALD, FRIDAY, DECEMBER 28, 1855. a it, feed by" irregularities {1 spectors, a w, OF irr eo in ‘equality in the votes cast,) vha'l not have beon suppliet at the general election next succeeds the in that giving at Teast ‘wenty: days noties, by proclamation, in every county of trict. gy aati of the much disputed thirteenth section, relator says:—“lt will not do to dis- regard this plain papsete vot the beeping 4 supposing cases inconvenience, or of evils whic! may result Miedema And ‘yor in. the, cae argument he cites as anthority the langusge of Mr. Justice Ruggles, in the Court of Apieals, that - when an instrument is worded (as this cectainly is not) in clear and precise terms—when its meaning is evident and leads ‘to no absurdconclusion, thee can be ne reason for re- admit the meaning which the words natarally import.” On this anthority, then, we may venture t» suppore a case, not of evil and inconvenience only, but of gross absurdity. will auppose—for the relator’s posi- tion goes that ts b—that Me Justice Morrts, the leading characteristic of wi dist ase was its suddenness, coming into town early on the morning of the election, in a moment, without warntog. dropped dead in his carriage, and thst his alone o ut of the vacancy, and ambitious, as he a right to be, of promotion trom the box to the bench, had gone to the and de-. posited for bimself » vote; aad that on counting the ballots next it had b+en simultaneously an- nounced that Mr. Justice Morris was dead, and that Mr. Justice Morris’s coachman bad been chosen ae not Je, including even the fortunate candidate, what an ‘absurd conclusion’ to a soleun event! The relator, without ing, bas endeavored to parry this absurdity. He rays in his cass, “ fall know: lodge of the vacancy was had by the electors,”’ and th “no wrong or injury has takeu place.” Even were the fact so, it would furnish no anawer in law; but the fast, in both its branches, as the re:ord shows, is procisely the reverse, Five thourand nine hundred and twenty one—not of the electors who t have staid at home—-but of the electors who actually attended and voted the judicial ticket, either knew nothing of the vacancy, cor bad po aufficient opportunity to prepare fresh ballota, or to Re their minis un- derstendingly to fill it. By adding and subtracting it will -be found that there were that number of ballots with only one name, (pennies it would seem for ths lon, term,) avd with no jignation except ‘‘for Justice o! the Supreme Court for the Fiest judicial distetct,”” or to that effect. “Ballots,” (as the complaint says,) were no doubt cast for the “‘long term’’ and for the “short term,” but not all the bailots. ‘There is not tho slightest probability (hat the ballots Seca 4 printed before the death of Judge Morris, and which, therefore, hed only one name, and of which it would’ seem nearly six thou- sand were actually deposited, containe? any special de- signatiog. The law required nove, aad none was proper. ‘When, therefore, the relator, in one of his points, saya that the ‘orm of the ballots ‘crought home to the no- tive of every elector that a justice was to be elected for ‘the long term and s justice to fill the vacaagy,” he ig- nores the existence of the 5,0: @3, too, a fact ublic and notorious, and proved in eifect by a pupiie cA But this is not all. It appears by the complitat that the cleciion. was held on Tuesday, commencing, of course, at sumise, the 6th of November; trat no idea of filling & vucency was seriously entertained till the 30:h of Osto- ber, and that the vame cf the relator, in particular, waa uot suggested im that connection till Saturday, the 34 of November, and, of course, was not Inwfully and regu- larly published til the morniog of Monday. Here, then, was an interval of twenty-four houre—sight of them devoted to slumber—for sixty or seventy thousand eiecwora to get information of the exigeney and tocanva:s the merits of the nominee, and to make ar rargements for concert of action. Unier these circum stances, in it to be wondered at, if such be the law, that a candidate with leas than eighieen thousand out ot more than Shy five thousand yotes, ehould take a saat on the bench which another, with neariy twenty-seven thousand at the same , fails to reach? Teas, one, itis said, was run for the short term, aud one for the long teem’ Stull, both, whether for eight years or five, were run for a seat on the same bench—and the conseuencs of the hurry, uncertainty end confusion, {f such an election be Jegully operative, is to deprive the people of the servicss of Mr, Justice Cowles, although nine thousand more of the electors voted for him than for his now competitor, Mr. Davies, and although six thousand ineffect hal no no- Ee that apy wpecial vacancy was to be, or legally could ‘So way, as the relator does, in view of such results and others of a like character, that “no wrong or injury has teken place,” ix to advance a proposition which, al- gh perlaps true as respects the reiator individually, is clearly in opposition to the fact #0 far as concorns the Dody of the electors, On thom, i this hurried an® irre. gular election 60 called be established, tho most tisgrant “wrong” will have been infic:ed; aud what ix a still more serious consideration, a privciple wilt have been settled, under which, in a population of belweea three and four millions, and with an actual voto of five hun. dred thousand, » Judge may be placed upon the bensh of the Conit ot Appeals, witnout single bsLiot in his favor except his owny and without any knowledge of che vactn- cy except - if. The conclusion to which this argument leads may be surnmed up in the following brief propositions: — First—That by the new constitution, contrary in that respect to the former ay tem, the SBiclary, whethe: wisely or not, ¥as intended, as’ far as practicable, to be mride elective directly by the people, Seeond——That the appointing power of the Governor, when showed to be exercised, was to be confined to spe: cis] emergencies, and to cease as eoon as, in the due and orderly course of things, those emergencies should cease and the popular will te ascertained. Third—That the “tmen” of electing Judges—whather on the “first Tuorday after the first Monday” of a gi month, or on the first Tuesday after the first eignteon cays, from the happening of a vacancy—were left to the ’ Legislature to be ‘iproseribed” as expressed in Article 6 vr to-be “provided!” as expressed in artisle 10, bi jaw.” Fourth—Tbat no election to fill a vacancy createl by death can consticutionally be held withoat # substantial compliance with the regulations in rd to‘! tide’ = other particulars ** prescribed’’ “« provided’? by Ww Fith—That the constitution itself ordains that the Legislature shall “preseciba”? aad“ provide’ such re- guistions, ang intended therefore that when made they should be observed, Sixth—That the minimum time, in the prosent instance, to which the electors were by aw entitled, was twenty: Sepinys— (ioe the 4th Uc:. to the 6th Nov.,)—and that aa the vacency in question happened so late as to allow less than fifteen, the alieged election to fill ir was not an¢ could not be held according to the regulations ordained by the constitution, to be made, and was pro- per y, therefore, treated by the executive as a nullity. fcven(h—That the vacancy crented by the death of Mr, Justice Morris not having as yet been “supplied by the electicn by the people,” wax lawfully “filled by appoint- went by the Governor.’ Kighth—That euch appointment will continue in force “un'il the vacaney ehall be supplied at the next general election of Judges, whem (or at which) it shall be sitled » dy election for the residue of the uuexpiced term,” that » is, until a general election takes place at which it can be filled by the eleotors witsout violating the rules and tions as to “time” and otuer particulars “pre- "ot ‘*provided’’ by law; or until a special elec- under the power given to the Legisinture to ‘pro- oe filling vacancies in office’ can be held and com- slered. Moth—That the Logislatare, in ¢xecution of the power 80 confided to them, having provilet that “if a veeancy proper to be supplied at a general election shall not hava en supplied at the general lection next sucoeding the happening thereof, a ~ rey election to supply anch va- cancy shall then be held,’’ is is the duty of the Governor, an directed by the statute, to ‘order such elretion, and 10 issue his proclamation therefor.” Tenth—That the article in the constitation which en- wer tion, id joins it on the 1 ‘ature, with © single restriction, to ‘provide for filling vacancies in « Weing sudsequeat in order, must, if necessary, be 5) construed as to cM-rol or qualify the sixth article which p-ecedes it. Heventh—Thet ibe judgment of the apecial term in favor of the detendant ought, therefore, to be medifled so for, and t “oclare the defrudent entitled to hold the office to which he has been appointed by the Executive, until and (nolud: the Slst of December, 1857, unlers the vacancy shall be sooner suppiled’ by a speci election, to be orsred for that purpose, and that, with euch modification, the jalgment be aflirme Note. —it may be proger here to observe, and to re- member, that if the doctrine, contended for by the relator, that im cave of a vacancy 0 no matter at bow late a period, ‘it shall (using the word fa the imperative and notin the subjunctive mood.) be supplied at the next general election,” and tbat the whole clause legally construed, moans, absolutely anPunqualifiediy, the very next ral election, sod not the next genera: election at wi conisteatiy with the aathorized provisions of ‘the Jaw, the vacancy can be lille’, and that the vacancy, i view of the constitution, terminates at the setting son op the vary day of tse elec ions ant is imme- y Olled by the success i candidate on the instant that tbe polls closed—suppoe say. this doe- trine to be sound, there were on the 6th of No- vember three feats on the Supreme Court Benoh to bo filled by election : one, thet of Mr, Justice Edwards, for about two months, the unerpi ed residue of hiv term; ope, that of Mi, dustics Morris, for abeat sixty-two montha, the unexpired residue of his term; and oae— tbat arisicg from the regular expiration of office—‘or the full term of eight years from the first of Jenoary, 1866. Avd the consequence would be that all the bsliots —or at least a very large portion of them, far more than vufiiclent to determine the result, and whieh there f+ no means of éistinguishing from the rest—were void for want of designation, ana that there ls now 50 doility of detes mining, with legal certsinty, which of the several persons voted fer was intended for hay particular places Ae to the 6.%1 votes whether for Cowles or Whiting— and they were certainly for one or the other— there was nothing on them to designate watch of the se places they were intended! od as to the 46,848, there was nothing on them to designate which of the vacancies, whether that of Judge Faw or that cf Judge Morris, they were intended to fil that, sdmitring the reja‘or's doctrine, there was dion, either of Mr. Whitiog, or Mr. Cow'es, or Mr. I or of any other candidate, either for a full oF for a res duary term—‘or eight years, or for t eight years and two months, or for any other oF period allowed by law 180 delivered sn « ng we fo lows:— Jones Brow laborate opinion upon the cave, eovetud Je’enéent is, T think, ealftted to the offer ia dis Ye. and the jatgment of the epecial term shou'd Hee efirmed, T ‘Taber Miss Sigour- Tresied Mrs, White st Tonner Mrs Mary J LIST OF LETTERS Remataing ta the New York Cty Pest Osice, hon itis Hoy Spout, Horde manda JJ be Teyiee irs Louse +f ies, Fesnson ats Hart Prensa yeni ideagh Yous Hma, vid Teyler Mic, 2 as Nona ‘Faroe ,.
