Col. Walk- er, after a conference with Geal. Manoz, who is in com- mand ef the Castellon forcess embarked for San Jaan del Sur, reinforced by 200 men. His party was thus in- creased te about 276, He appesred off Sam Juan, and landed his ferces on the night of the 27th ult., at Bro- ‘to, about 14 miles north of San Juan, while the next day, his vessels, the Vests aud « schooner, appeared off the harbor of San Juan, te draw off the attention of the ‘troops there. Im the morning the troops were hurried off in great precipitation to defend Rivas, which Walker had assaulted, and is reported to have taken, The next night he took San Jusa del Sur, without suy re- sistance, and seized all the arms and smmunition de- posited there. The application for an imjunction was founded on the grounds—first that the deed contained a covenant tnat the Battery, ro callec, and the vacent grounds belong- to the Corporstion in the vicinity of the premives, shall never be appropriated to private use; aad the plaintuf contends that the enclosing of it for such « pur- pose as is intended by the Commissioners of Emigration would be # violation of that covens: The Court holas that this covenant did not apply to the parties now in- terested, as at the time that covenant was made the pre- mises in question were not vacant, because they bad been ceded to the United States, and therefore were not ®& part of the Battery or Bowling Green. The Court could not therefore hold that this covenant extended to ery which did not then exist under that appellation ‘the questioa of the pro depot being s auisance, the Court would act interfere unless in cases where from long continusnce or other reasons there was proof to show that it wasanuiseance. The weight of medical tos- timony and the evidence of otber officials went to prove that if would not bea nuisance. I¢ was urged, on the other band,that it would be a nuisance, because a Judge of the Supreme Court decided that s similar depot at the foot of Hubert street was a nuisance, and from that decision no a, was taken.
