We have never known an instance in this country where the preperty of an individual was taken to liquidate the claime of bill holders, In the oase of the Commercial Bank of Perth Amboy. in the face of the above law, the bill holders murt look entirely to the sesete of the bank and the fuithfuiness of the reeeivers appointed under the injunetion. This shows what folly it is to make laws for the security and protection of bank bill holders. ‘The only rea! safety is in the deposit of stocks in hands entirely indcpemdent of the banks. A deposit of such seeurities with the comptroller, or some other state cilleer, beyond the control and influence of parties eonrceted with any banking institution, gives the bill- holder confidence, in « proper appropriation of that pro- ty for bis benefit. Without « «ystem similar to that eration im this State, the creditors of abank have no guarantee that the assets will be devoted exclusively to the peyment of ite debts. At the time of ite failure it mey bare had property enough to pay at least ite bill- bolders, but before an injunetion could be placed upen that property, or receivers appointed to protect it and pre- vent any director fromearrying it off, everything had dis- ap peared, and no one could be found who knew anything about them, We have so little faith in the honesty and integrity of bank managers generally, that we would not ‘trust them with the arsets one moment after the credit of the inetitution had been destroyed and nothing more was to be made by preserving the bank's good name, ‘The free banking system of this State and the new banking system of New Jersey are about as near perfeo- tion as it is possible to get them. We have amended and Improved. from time to time, the free banking law of this State. At first, it was very defective, and lasge Joanes were realized by bill holders. A very important change, in the chareoter of securities deposited with the Comptroller, was required, and at once made, and we have not yet dircovered the first defect in the law as it now stands. Whatever loss holders of bills issued by the free banks of this State, which have recently euspended, wey suffer, will be caused by the carly imperfections in the law. None of the banks of this State, which have commenced operations under the law as it now reads, can take one cent from bill holders. Their seeurities are tocks of the Btate of New Tork and of the United States, recetved at thelr par value.
