A jleavant little émeute has occurred between Dr. Cunnington, the leader of the Walnutastreet theatre orchestra, and Messrs. Smith & Coffroth, the pub- li-herw of the Spartt of the Times. Ii will be re- membered thet a certain Freeman Scott, some months ago, published a patriotic sony absut the Union—not old Ritchie's but Uncle S«ii's—to which song Wes attached a sort of postsert, offering a prize of fifty dollars to the musiciua who should compose the best air thereto. This prize was, after due deliberation, awarded to Dr. Cuaniagton. Ia the Spirit of the Times, of this city, of the 25th ult., there appeared a communie ition, alleging that the melody was orginally composed by a lady, who handed it to br Cuwniagtoa for his judgmeat thereon, aud that this same melody was slightly altered by the doctor, and used as his own pro- petty. Thereupon the doctor enters suit agaiost the publishers and editors of the T'imes, before Al- derman Mitchell, charging them with libel. The parties appeared before the magistrate on Fridty, and declared that they could produce proof of the logiariem, if a postponement of the case was had This was duly granted, and they were held to bad in $1,060 euch, for a further hearing, oa Friday next.
