Carrain any Mate chanced wiTH CAUSING THE Deatn or 4Sar_on.—Lewis Thomas, master, and Peter Jobnson, mate of the ship Unicorn, were brought up before Charles L. Woodbury, Esq. United S*ates com missioner, upon complaints charging that by assau'ts of various kinds, and at different times, they caused the death of John Smith, alias John MeLennen, on the 26th of October. It appears from the evidence athat Smith had been shipped at New Orleans, and ‘was in yood health when he came om board; that when two baa fe out he became unwell, and gave dis- satisfaction by the slow and inefficient manner in which be took hold of his work; that the captain ropes- ended him.and the mate beat him with his fists, and kicked him repeatedly; that this course of treatment was sontinued for several days, till he took to his berth. After lingering four or five days, during which the captain administered some medici: to him, he died. For thirty hours previous to his death he was delirious, His body bore numerous marks of blows. Grounds of defence indicated hy the cross-examina- tion are that he came to his death by some disorder which he bad upon him when he joined the vensel, or it was caured by delirium tremens.
