To the Hon. the Legislature of the State of New York, now in Session, Your memorialist, a citizen of Poughkeepsie, and a constituent of the Dutcheas Delegation, would respectfully represent to your honorable body, that he has seen, through the medium of the publi ic prints, that a bill To punish.Seduction and Adultry as crimes, and for other purposes,” has been presented to the consideration and approval of your honorable body, and which bill appears to have been formed in accordance with the Drayers “on your loaded table,” emanating {rom a ‘ ‘numer- ous, Virtuous and estimable class of citizens,” majority of whom are females. In the details of said bill, the attention of your memorialist is forcibly arrested by its one-sided and partial character: Wherein the male is proposed to be totally disarmed, and the female clothed with an oppressive and dangerous power over him; severe penalties are rcpaeee to be inflicted on the seducing male, whilst that of the seducing female appears to have entirely escaped the vigilant care of your honorable committee in forming the bill. To this partial feature of the bill, (withont impun. ing the motives of any,) your memorialist would beg leave to remonstrate. The crime complained of, if it be a crime, must be committed by both inale and female conjointly, and both should be held equally liable, and to stand confronted, that justice may ascertain between the seducer and the seduced, or whether the seduction would prove to be mutual. The law of Moses would stone both to death. Also, the damsel taken to the marriage-bed, who wasfound to have parted from her chastity, which his and our law would protect from violence, was to be returned—he be- ing released from the consequences of the unfortu nate marriage, and she to be stoned.. It should be remembered that we have sons as well as daugh- ters. Your memorialist would solicit the attention of your honorable body to the consideration and pro- priety of so amendin, said bill as to embrace ** man, male and female,” and in transgression to place them on equal footing. Your memorialist is confident that the propriety of this course will meet mreacy response in the minds of your honorable ody. Has not the seductions of the female, from time immemorial, in all ages, been a just subject of com- plaint, both by “fathers, husbands and brothers,” and does not the mothers, wives, sisters and daughters, need your care 1n the bill equally with them. Is it not notorious that he, otherwise “ virtuous,” ie equally exposed to her seductive wiles. A wise man hath said that “a virtuous woman is a crown to her husband,” and then exclaims ‘who can find a virtuous woman 7” It is of prevalent belief, founded on ancient chronology, that the first man was tempted, seduc- ed and betrayed from the path of rectitude by the first woman! and of consequence entailed misery that should well deserve his commisseration, and of her reprobation. Your memorialist would beg to be permitted to call the attention of your honorable body, toa few cases, (among the many that might be adduc- ed) of the any of woman. Two of Lott’s daughters, by stratagem, com- mitted seduction and incest with their father ! Jacob (called Israe)) the son of Isaac, the son of Abraham, had twelve sous, by four women of his household, and one of them, Judah, a conspicuous prince in israel, in an unsuspecting moment, by ambush, on the ” wayside, was beset, enticed, and seduced by Tamar, his daughter-i Ww, she dis guising herself to that ot an harlot. She was brought forth anon to be stoned, yet was saved by clemency and pardon. Another of Jacob’s sons—the first-born of his fa vorite Rachel, and his favorite son—Joseph, after being tradaced, and treacherously abducted by these, his mixed brethren, and sold to Potiphar, in Egypt, was sorely | beset by the wiles and seduc- uons of his master’s wife; and, for his resistance and fidelity, was falsely” accused of attempt to crime, of which herself only was guilty, aud he sent to Pharoah’s ‘‘State prison.” It the quotation in the report of your honorable committee is worthy of meditation and comment of “one whose graphic pencil drew human nature to the life,” that “Heaven hath no plague like love to hatred turned, Nor hella fury like a woman scorned,” then we have the key to Joseph’s unjust. punish- ment in Pharoah’s “State prison.” And to the formidable power now granted her by your laws, and to “scorned love,” would you weigh gold or count dollars to ‘‘pander” to the avarice and cu- vidity of a ‘*hellish fury,” to bear een against the victim of her selection, whose crime, like that of Joseph's, might be virtue. Would you not give him an equal chance tor justice. Can it be possible, that such discrimination as the bill provides is the prayer of virtuous women, who have so constantly ‘loaded your table ?” Has virtue lost its power? Then let her appeal to the laws you have already granted her, by which to se- lect her victim. And would you prostrate him to her feet, there to beg that it may not be a Joseph ? Is there not cause to apprehend that this feartul power is now abused, not by the ‘‘virtuous,” but by the avarice and cupidity of the “‘furies ot hell,” and to require the grave consideration of your hon- orable body for its amelioration? Under such a ‘aw as the bill proposes, where could be found the eafety of trembling man? Would she rule supreme over his degradation? Would your honorable body repel man, by fear, from the smiles of women, and in her anger place him a victim to her power, and cast him over to the ‘‘furies of hell.” Are there none of courage to face the violent torrent, and to repel the taunts and reproaches of zealous bigots, and to ask for equal justice for the criminal, whether male or female, without fear, favor, or partiality ? Let our frail sons and daughters, equal in the sight ot God, be taught the benign and lasting fruits of virtue—a shield that will defend and repel the most poisoned arrow—only to be obtained but by prudence, circumspection, and perseverance in the path of rectitude—yes, conscious rectitude! “A conscience void of offence” is a pearl of great price—a solace that none can give nor take away— an ark of safety and pillar of hope. Let them also be warned of the danger and peril to which they will expose themselves on the least departure from this benign and vital principle ; for to rebel against the convictions of light ead truth is partaking of forbidden fruit, and “a guilty conscience who can bear?’ We are naked in the sight of Omnipotence, who, ‘‘without Tespect of persons, judgeth accord- ing to every man’s work: Hence, your gnemorialist would solemaly and firmly remonsirate against the passage of the bill, os rie by your committee to your honorable beg yi, 17, 1845 BENJAMIN ARNOLD. ‘ebruary In Supreme Counn, March 7, 1845.—March Spe- cial Term.—-Mr. Justice Beardsley presiding.— Nisbit ads McCotter. Festivities—Fires—Murder—- Theatricals— Politics. Frignp BENNETT { suppose you will be glad to hear from bi away down South,” and this goodly and godly city. I have been here and hereabouts for some time, @ looker on, and have seen considerable to look at. We have had a due share of rational amusement of late. Fires, hangings, balls, theatricals, &c. This being Inauguration Day, we are to indulge in the tallest and heaviest kind of a ball in honor of the people’s man, and our own success. All the women having any claim to beauty and youth are invited. We had a very respectable fire the other night, (for Savannah)—a large cotton store house, containing about 2000 bales, with the Odd Fellows” Lodge overhead, was totally consumed, also a small wooden house adjoining. I passed the scene last night, and the cotton, still burning, visible through the door and window openings of the blackened and still standing walls, made it look like a cavern of hell. I should hate to be the owner of much property here—the town 1s built of pitch pine, which burns like tar—but the bleesings of poverty are great, and I can sleep even here—a quiet con- science and no money are the best opiates thisside the grave. vets here, men, women and children, negroes and dogg, all run to a fire together. They ought to see tes coolly they take it in Gotham. A negro was executed here a few days ago, fora murder most foul. He died with great gallantry and penitence. A minister made some common lace remarks, which were heard with much s0- f lemnity by the ‘fashionable audience, thus giving the lie to the Greeleyites—the victim also address- ed the people with great coolness, but impressively. The clergy here are a humdrum set of men; the only ones having pretensions to eloquence are the sailor’s preacher and the Unitarian. This last preaches sound doctrine, and is an elegant writer. Theatricals are at a low ebb here,as every where. You, and you alone, have discovered the true se- cret of this and pnblished it to the world—the third tier must be abolished before our pious countrymen willendure the theatre. Miss Clifton was here, ba drew no houses, beautiful and good though she A negro has, I forgot to say, been arrested, charged with setting fire to the cotton establish- ment; and, asthe death of one man ensued from the falling of the wall, he will be likely found guilty, to tollow his brother murderer. Your New Yorkers seem to think that Silas Wright staads a chance for the Presidency, but I can tell you he stands no chance of southern votes, and you can make your bets accordingly. The Texas business has ruined him. Great rejoicings are here at the final passage of the bill. Yours ever, J. W. B. Latest rrom THE Nortu.—The following dis- patch was received yesterday at Livingsten & Co.’s famous express office, in Wall street:— ALBaNy, March 8, 1845. The House adjourned at an early hour to-day, as a token of respect to the memory of Hon. Levi S. Chatfield, deceased, Speaker of the House in 1842. Mr. Chatfield was a member of the Aseembly in 1840, 1841 and 1842, and resided at Laurens, Ot- sego'County. 'e have several petitions from New York that the Erie Railroad Compeay be compelled to con- struct their road through the southern tier of coun- ties to Binghamton, as a condition of releasing the lien of the State on the road. Also, requiring the railway companies between Albany and Buffalo, to travel their roads with greater speed, and for the app ointment of a commissiener to supervise them. emonstrances against par redemption in New York or Albany, and petitions for and against dis- criminating tolls flow in as fast as ever. Mr. Wueever presented the memorial of the Ke ror of New York on the subject ot Emigration Pauperism. It was reterred to a select com- aiittes poasienns of the delegations from New York, Kings and Richmond counties. A memorial of near 500 sailors of the port of New York against the bill taxing them a higher rate for hospital money, was presented. A bill was reported to compel the Long Island Railway Company to keep their track clear of cattle by fencing in their roadway. Ia the Senate memorials, were presented from the Common Council for the repeal of the Mill Tax, and for the regular annual tax bill. A peti- tion was also presented from owners of lots be- tween Bowery and Broadway in favor of closing Eleventh street. Gas is the rage of the day. The Senate has re- Ronee a bill to increase the capital of the Albany yas Light Company to an extent sufficient to en- able them to carry on their operations. They will be in full blast by Sept. next. Buffalo, too, is pushing alongside of Albany, and hasa bill reported to organize a company. Mr. Smitu, of Suffolk county, has reported a liberal bill to extend and protect the interests of the agriculturists by extending ihe previsions of the act of 1841. Mr. Lester has reported a bill for par redemp. tions. Itcannot succeed. This is not a fair move towards the country banks. They pay their notes in specie at their counters in accordance with the provisions of their charters, and what right have the Legislature to say they shall keep them at par in New York or this city. Leave the currency alone. For all business purposes these bills are current ail over the State at specie rates. Will not that suffice these currency tinkers? ‘ Let well enough alone” @ most exeelient maxim. Pass this bill, and you will blot out of existence hosts ot institutions now performing their obligations faithfully and with advantage to the community were located An important bill, of which a syno| pablished in t general city papers, is now under consideration in the Senate. mt is a bill of general application, proposing %. apply the knife to town and county expenses. My only fear of its passage is that it proposes to lee late out of office so man: perrorsthat members of the Legislature would fin \c unpopular at home. One great source of objec- tion to the present Common School law arises trom the fact that it abolished the offices of town super- intendents and commissioners, and thus left hosts ae achance for an office. Such is the love of office. The House of Assembly of Canada have adopted a resolution by a vote of 43 to 40, in which the principle of paying for the losses incurred by the rebellion of 1837-8 is recognised.
