Colt Committees’ Report.—Alderman Crotrvs, from the Committee of Police, presented the result of the any ms tion relative to the attempt to bribe Sheriff Hart with the five $100 notes. The committee have examined a number of witnesses, but no new facts were elicited, except that the money was delivered to Sheriff Hart, at the house where he boarded. on the evening previous to the execu- tion, by aman who cameinacab, Aboy named Robert A. Russell, who resides on the same premises, called \.r. Hart to the door, hee him that a person who had come in a cab wished to speak to him, andon going to the door the letter was delivered tohim, He went into the house to examine its contents, and perceiving what it was re- turned to the door to find the person who gave it to him, when he had left. Gray.—At the opening of the Court, the trialof this man, indicted for burglary in the third degree, was continued trom Friday last. “Phe in- dictment charges him with entering the clothing store of Messrs. Whiteley & Richardson,then of No. 1} Ann screet, on the 12th of March last, in company with William Kingston alias Joseph Mallett and William Banvard; and stealing $600 worth of clothing. Otticer Ginuenr D. Hays testified that he arrested Gray, and when Mz. Whiteley saw him in his cell he identified the clothing on him as having been stolen from his premi- ses. When Whitely recognised the coat, Gray slapped his hand on one of his legs, and said, “ Yes, and these are your pantaloons.” ‘The deteuce, couducted by George Wilson, Esq., con. tended that the oaly evidence agaist accused wus his own declarations, which were extorted from him by the officer, on a pledge that any expressions that he made Should not be used against tim, provided such informa: og HeAded Ne MERIT ARPA eMeT lor the defence, and deposed that he had held out inducements to Gray to expose his accompliccs. fhe Court ebarged that the duty of the jury alone was te decide whether they thought prisoner guilty of the burglary, as the confession of prisoner was a matter for the consideration of the Court alone, and not the jury.— ‘The jury, after a short absence, returned a verdict of guilty. Second re Gray.—The prisoner was then put on histrial on an indictment for burglary in the first degree, in attempting to enter the store and dwelling of Wm. Whittingham, 389 Broadway, on the night of the 6th of April last. Wm. Whittingham testified that the night in question, he was awakened by one of thecity watchmen, who had arrested the prisoner Gray in front of his house, while in the attempt to force open the front cellar doors, The deposition of Andrew Rogers, the watchman, as taken before the magistrate, and his cross-examin: by counsel for prisoner, was submitted to the jury, in which Rogers asserts positively that he saw Gray, with two others, attempting to force open the cellar doors, and when he rnshed forward to make the art the other two escaped. Gray was arrested and committed under the charge. The defence offered no evidence, but George ilson, Esq. summed up for prisoner, and endeavored to satisfy the Jury, that the vision of watchman Rogers, was not stich as to bring home the burglary to his client. The Jury also rendered ajverdict of guilty in this case. Gray was then arraigned for sentence, but’ begged so hard for a short delay, that his sentence was postponed till F ‘There aretwo other indictments against him for burgla- ry, butit being in the power of the Court to sentence him for some twenty years on the two convictions, the other cases willnot betried. He has intimated that he isin possession of much valuable information relative to bur- glaries committed in this city, in which Bill Kingston, Banvard and others were concerned Tried for stealing ashirt—John W. Brower, was tried and convicted of petit larceny, for stealing a’ shirt from John Evans, of 93 Bowery, on the 26th of last month, the article being found on his back. The Court sent him to the Penitentiary for six month: 4 Trial of William Sawtell.—This man was tried on an indictment for grand larceny, for breaking open the trank of John Heath, in company with a man named Robert Wallace, on the 16th of September last, while boarding in the house of Mrs. Widmer, of 317 Water street, and steal- ing clothin gvalued at $81. It was proved by the confes- sions of Sawtell, that hs went with Wallace to pawn the ‘oods at Hart’s, in Pearl street, but that he did not know they were stolen. It was also preved by prosecution that a man was seen to come out of one of the rear windows of the house, with clothing in his possession, but there was no proof that prisoner was the man. ‘The cause was sub- mitted without any evidence for defence. and the jury re- turned a verdict of not guilty. Sawtell was then dischar- ed. Frat for Burglary.—A thieffaced looking vagabond, named John Duzenberry, and a boy aged about seventeen, named John Frazer, were tried for burglary in the third degree, in entering the counting office of James Tisdale, coal dealer, 413 Water street, on the 26th November, and sterling $2 hange, and a map. ‘The prosecution proved by Daniel McDonegal, employed on the premises, that he went to the yard at 12 o’clock on the night in ques tion to feed his horses, when he found the prisoners in the counting room, and giving chase in com- pany with Charles Davison, they caught both the prisoners, and in possession of the boy they found the map stolen; and elso that Dusenberry, while being pursued, threw rome change from his pock- . Davison testified that one of the windows of the eounting house was open iso the rear door, but that there was no evidence of any forcible entrance. | ‘The de- fence contended that there being no forcible entrance, they could not be convicted of burglary ; and as the amount stolen was under $26, the only legal verdict ren- dered could be guilty of petit larceny. ‘The Court charged that the mere raising of the wmdow, unless it was wedged or fastened, would not place the charge under the head of burglary, as defined in the statute. ‘The District Attorney contended in reply that for the last twenty years it had been decided by this court that the mere opening of the door or raising of the window was a burglary, and it was only in the last few months that such decision had been reversed by decisions in this court. Under the charge of the Court, the jury returned a ver. dict of guilty of petit larceny only, and the Court sen- tenced Frazer tofour months, and Duzenbury to six months, in the penitentiary. juabble among Passenger Runners.—Wm.
