Granted, in Confideration of the brave defence, made by the Inhabitants during the Astack of three Months. Upon Condition that they lay down their Arins, fo foon as they have march’d by our Troops, and that all the Forts, Pofts, Batteries, Cannon, Mortars, Firelocks, Bay- onets, with all kind of Ammunition and Im- plements of War, be delivered toa CommifJary 7% be named by us, and that we (ball bave a Power of fixing Garrifons in all fuch Places as we [ball think proper. II. The Inhabitaats of the Ifland of Mar- tinique, Marigallant, and Dominique, who came to the affiftange of thisIfland,(hall have leave to retire with their Arms,and Baggage, and a Ship fhall be provided to carry them and the Servants they brought with them, to their refpective Iflands with Provifions for their Paflige. Granted, excepting thofe from Marigallant, who (ball be fent to Martinique. III. The Inhabitancs fhall be allowed the Free and Public exercife of their Religion, the Priefts and Religions fhall be preferv’d in their Parifhes, Convents, and all other Poflzflions, and the fuperiorsof the feveral Orders fhall be permitted to fend for fuch as they think neceflary from France and the neighbouring Iflands, but all Letters on this Occafion, fhall be tranfmitted by the Governor appointed by his Britannick Ma- jefty. Gramted. IV. They fhall obferve a ftrit Neutrality, and not be forced to take up Arms againit his moft Chriftian Majelty or any other Power. Granted, on Condition that they take an Oath within a Montb, or fooner if poffible, to main- tainall the Claufes of the Capitulation, as well as toremain exaltly and faithfully Neuter. V. They fhall be -allowed their Civil Government, their Laws, Cuftoms and Or- dinances, Juftice fhall be adminiftred by the fame Perfons who are now in Office, and what relates to theInteriour police of the Ifland, fhall be fettled between his Britan- nickMajelty’s Governor and the Inhabitants, and in cafe this Ifland fhall be ceded to the King of Great-Britain at the Peace, the In- habitants fhall have their Choice either to keep their own political Government, or to accept that whieh is eftablithed at Antigua and St. Chriftopher’s. Thelnhabitantsas well asthe Reli- gious Orders fhall be maintained in the pro- perty and enjoyment of their Pofleflions and Goods moveable and immoveable, noble and ignoble of what nature {cever they may be, and fhall be preferved in their Privileges, Rights, Honours and Exemptions, and free Negroes and Mullatos their Liberty. The free Mulattoes and Negroes, who have been taken, thall be confidered as Prifonérs of War, and noctreated as Slaves. Granted. . X. The Subjefts of Great-Britain, who have taken Refuge in this Ifland, whether Criminals or Debters, fhall have leave to retire. Granted. XI. Noother but the Inhabitants attually refiding in this Ifland ‘hall poflefs any Lands or Houfes by purchafe, grant or otherwife before a Peace. But if at Peace thisIfland fhould be ceded to theKing of Great-Britain, then fuch of the inhabitants as do not choofe to live under the Englith Government, fhall be permitted to fe!l their Pofleflions, Move- ables and immoveables, to whom they will, and retire wherever they pleafe, for which purpofe there fhall be a reafonable Time allowed. In cafe there {hould be any exchange at the Peace,their Britannick and MoftChrif- tian Majefties are defired to givethe Perfer- ence to this I{land. This will depend on his Majefty’s Pleafure. XIII. TheInhabitants fhall have Liber- ty to fend their Children to be Educated in France, and to fend for them back, and to make Remittances to them whilft there. Granted. XIV. The abfent Inhabitants and fuch as are in the Service of his Moft Chriftian Majefty, fhall be maintained in the enjoy- ment and property of their Eftates which fhall be managed for them by Attornies. Granted. XV. The Wivesof Officers and others who are out of the Ifland, fhall have leaveto retire with their Effeéts, and a Number of Servants {uitable to their Rank. Granted. XVL The Englith Government fhall procure for the Inhabitants an Exportation for fuchCommodities as the Ifland produces, and are not permitted to be imported into England. Granted, as the Ifland produces mothing but what may be imported into England. XVII. The Inhabitants fhall not be o- bliged to furnith Quarters for the” Troops nor Slaves to work on the Fortification. Granted, but Barrackswill be provided as foon as poffible for the Lodgment of the Troops, and Juch Negroes who [bali be employed with the Con- fent of their Mafiers on public Work, (ball be paid Jor their Labour. XVIII. The Widows and other Inha- bitants who through Illnefs,Abfence, or any other Impediment, cannot immediately Sign the Capitulation thall have a limitted Time allowed to Accede. Granted. Bus allthe Inhabitants who choofe i to partake of the Advantage of the Capitulation, [hall be oblig'd to fignit within a Menth from the Date hereof, or quit the Ifland. s XiX. The Meca belonging to the Priva- teers and others who have no propertv in the [fland, and are defirous’to leaveir, fall have Veflcis to carry them to Maruineceand Dominiqne at their Option, and fhall be furnithed with Provifions for the Paflage, ae- verthelefs thofe Perfons who haveanyDebrs with the Inhabitants of this Ifland, fhll be obliged tofettle their Accounts with them before they depart. Granted. XX. The Inhabitrnts fhall have Liberty to give Freedom to fuch Negroes as they have promifed it to, for the Defence of this Ifland. The Inhabitants and Merchants of this I{land, included in the prefent Capi- tulation, fhall enjoy all the Privileges of Trade, and upon the fame Conditions as are granted to His Britannick Majelty’s Sub- + je€ts thro’out the Extent of his Dominions. XXII. The Deputiesof the Grand Ter- re, not having a fufficient Power co fign the Capitulation, though the Colony adheres to the Conditions of it, under the Authority of M. Nadau, may fign it when they havetheir full Powers, and they will be comprehended inall the Claufes of it. Granted.
