An ACT for regulating the Proceedings t8 extinguifh Fires, that may be accidentally, or other- - ways kindled, among Buildings, and for preferving the Goods that may be thereby expofed. "HE RE AS it often happens, when Fire breaks out among Buildings ibat are contiguous, or near together, that the People who affemble to extinguifb it, run into Confufion, and proceed in fuch a diforderly Manner, as defeats the good End at whick ‘ they zim. - And as Goods are at fuch a Time unavoidably expefed, fome ill-minded Perfons take Aduvantage of the Calamity, and Jfieal fuch Goods, which bappens many Times to be a double Lofs, and occafions great Difirefs. g For Remedy whereof, . S , Be it Enafted by the Governor, Council, and Affembly, That every Town and Parith (having Town Powers) may at their annual Meetings, if they fhall judge it proper, make Choice of a Number, not exceeding Nine, nor lefs than Five, fuitable Perfons, being Freeholders and inhabiting within fuch Town or Parifh, as fhall chufe them to be Firewards, and fhall be fo called, who fhall have 4 proper Badge to diftinguifh thénin their Office 5 which Badge fhall be a Staff, Five Feet in Length, colour’d red, and headed with a bright Brafs Spire, of Six Inches long. And at the Time of the breaking forth of Fire, and during the Continuance thereof, the faid Wards, within their relpective, Limits, are hereby fully authorized to diret and govern the Labour of all Perfons who fhali be prefent, and wholly dire& what Labour fhall be done : And alfo to require and command Affiftance for extinguithing the Fire removing and fecuring Goods in Danger of being eonfumed or embezzled. . 3 * And the faid Officers are_ hereby required, upon Notice of the Breaking out of Fire, within their refpective Limits, immediately to repair to the Place, taking their Badge with them, and vigoroufly to exert their Authority, for requiring Affiftance, and purfuing the beft Metheds they poffibly can, to extinguifh, or prevent the {preading of the Fire, and to preferve and fecure the Eftates of the Inhabitants. And due Obedience is hereby required to faid Officers, and each of them, for.that Service. .~ And any Difobedience, Refufal, or Neglet, of any Perfon, capable of doing Service in fuch Cafes, being complained of by any fuch Officer, to any Two of his Majefty’s Juftices of the Peace for this Province, within Twenty Days after the Offcnce, and being thereof convicted, fhall forfeit and pay, for the Ufe of the Poor of the Town or Parith where the Offence fhall be committed, for every fuch Offence, the Sum of Five Pounds.. . - e : : ; ; And when any Fire fhall break oat as aforefaid, the major Part of fuch of faid Officers, as belong to the Town or Parith, where the Fife fhall happen, that fhall be then prefent, are hereby impowered to caufe any Houfe, Houfes, or other Building, to be pulled down, or blown up, as they fhall judge necelary, for ftopping the Progrefs of the Fire. And if by deftroying any fuch Houfe, or Building, the Fire fhall be ftopped, or if the Fire fhall be ftopped before it fhall come to the fame, every Owner of fuch Houfe, or Building, fhall receive reafonable Satisfaction for the fame, to be paid by the other Inhabitants. For which End, the Sele&-Men of faid Town or Parith, are hereby impower’d and order’d, to compute and adjuft the Damage that fhall be thereby fuftain’d, according to Equity.. And toaflefs the Poles and Eftates, within the farhe, liable to pay and make good fuch Damge, in a juft proportion, according to the Rule by Law prefcribed for Town Rates, to be levied as other Town Rates. And if fuch Sele&-Men fhall unreafonably refufe, or delay, to perform the fameé, or fhall not do” Juftice to any Party aggrieved in fuch Cafe, he, fhe, or they, may apply to the Court of General Seflions of the Peace, of faid Province,at any Time within Six Months after the Damage fhall happen, for Redrefs 5 which Court fhall have full Power to hear and determine fuch Complaints, according to Juftice and Equity, and ro make fuch an Affeffment as {hall be neceffary to make fuch Satisfa@ion, with incidental Charges ; and the Money which fhall be collected for the End aforefaid, fhall be immediately paid to the Party fo damnified. But if the Houfe where the Fire (hall firft begin and break out, fhall be pulled down, or blown up, as aforefaid, or unlefs the Fire be {topped by pulling cown any Houle, or Building, as aforefaid, or blowing up the fame ; in thefe Cafes, the refpective Owrers fhall not receive, or be intitled to, any Pay as aforefaid, for fuch Damage. . [~ | And be it farther Enatted, That if any Perfon, fhall, at the Time of breaking out of Fire as atorefaid, take and conceal any Goods,' not belonging to him, or her, and fhall not give Notice thereof, and beftow the fame to the Owner, or Owners, if known to fuch Perfon, or bring faid Goods to fuch Place as fhall be appointed by the faid Firewards, or the major Part of them, within the Town, or Parifh, where the Fire thall happen, within Twenty Days after the making Proclamation in fuch Town, or Parifh, by the faid Officers, for that End ; the Perfon, or Perfons, fo offending, being thereof conviéted, fhall be fubjet to the fame Fine and Damages as in Cafes of Theft, to be profecuted and recover’d in the fame Manner. : : And if any Perlon fhall affume faid Office, not being thereunto lawfully chofen as aforefaid, or ufe the Badge aforefaid, he fhall be liable to pay a Fine of Ten Pousids, for the.Ufe of the Poor of the Town, or Parifh, where the fame fhall be done, to be recover’d by A&ion of Debt, by the Overfeers of the Poor of that-Place. _ And any Towh, or Parifh, aforefaid, may, as often as there fhall be a Vacancy in faid Office of Firewards, by Death, Removabk out of fuch Town ot Parifh, or Incapacity to a@ therein, chufe any other fuitable Perfon for faid Office, before the annual Meeting of fuch Town, or Parifh. , 5 i j Province of New-Hampsurre, In the Houfe of Reprefentatives March 3d 1758.
