Pollard of this city and Frank A. Pollard of Meri- den against the New Britain Trust Co, administrator and Florence Hutchings of Eustis, Florida, chief beneficiary in the will of the late Albert W. Pollard who died in this city May 21, 1 They claim breach of agreement. The plaintiffs claim that the will provided for a bequest of $1 to Al- bert C. Pollard and one of $100 to rank A. Pollard and that the re- mainder of the estate went to Flor- ence Hutchings after certain other legacies and bequests were made. They further claim that after they had made a threat to contest the admission of the will an agreement was reached with the chief bene- ficlary regarding the disposition and distribution of the estate. A dupli- cate of this agreement was flled with the New Britain Trust Co. on June . 1925, they assert. It is the further claim of the plaintiffs that the administrator filed its administration account in pro- bate court on July 21, 1926, showing that property on hand for distribu tion amounted to $11,121.90 and that on or about July 24, 1924, a mutual agreement was entered into for the purpose of carrying out the terms of the agreement with Florence Hutch- ings, a copy of which was mailed to her Florida home. It is asserted that she has neglected and refused to comply with the terms of the agre jment. They allege that the New | Britain Trust Co. has refused to turn over to them their share of the | property remaining for distribution. Attorney Denis T. O'Brien of Meri- den represents the plaintiffs and the {writ is returnable in the city court ;of Meriden the first Tuesday of { June.
