DIVORGE FOLLOWS SECRET HARRIAGE Ina Clare Asks Court fo Fre Her From James Whittaker Chicago, Oct. 16 (A—Ina Claire, comedienne, once the star in “Grounds for Divorce,” wlill repeat the role here, this time in the cir- cuit court. She has filed suit for divoree from James Whittaker, former . Chicago newspaper man and music critic, charging desertion and cruelty, , They were married six years ago ~~'"a jazz marriage,” the actress told & dramatic critic while playing In "Grounds for Divorce,” here, “I had always fancled myself parading to the altar in white satin and pearls,” Miss Claire said then. “Instead Jimmy and I motored to Wheaton, Illinols, and were married with the chauffeur and an unknown man in blue overalls, recruited from the street, as witnesses.” They kept the marriage a secret. The actress’ dill, filed through her attorneys, since she and Mr. Whitta- ker are in, New York, charged that her husband left July 14, 1023, while they were occupying a “honey- moon apartment” of three rooms on Chicago's north side. Mr. Whittaker “wjth great violence and force" ejected her from the apartment, she charged. Two weeks bafore, the bill contin- ued, her husband struck her in the face, while they were vacationing at Tomahawk Lake, Wis. Anent the secrecy of the marriage, Miss Clair once sald: “My friénds have sald that Jimmy should be called ‘Mr. Claire’, but he's never called that in my presence and I'm never called Mrs. Whittaker before bim.
