Whitaker Thompson, in the United States district court, has held that officers and directors of brewing companies cannot_be convicted of a criminal act by the corporation un- less the government shows they had knowledge of the commission of the offense. . In rendering his decision Judge Thompson ordered the acquittal of Julius Class, president; M. J, Cooper, vice-president, and KEdward Nau- mann, secretary-treasurer of the Rising Sun Brewing company,’ of charges of manufacturing and dis- posing of illegal beer, The three were indicted with the corporation, the first proceeding of its Kind in this district since the ad- vent of prohibition, and their prose- cution jointly with the corporation was regarded as an important test of the liability of individual officers of breweries for the criminal acts of the corporation, The court retused to dismiss the indictment against the corporation although Judge Thompson quashed three of the six counts, declaring the government had failed to sustain them by proof.
