RUTHENBERG ASKS: VERDICT DROPPED Rttacks Constitutionality of Michigan Syndicalism Act Lansing, Mich., Sept. 19.—Charles E. uthenberg, under conviction on a charge of violating the Michigan anti-syndicalism act, today filed a brief with the state supreme court asking that his conviction be set aside. His brief contends the anti- syndical act is unconstitutional. Ruthenberg with 16 others was nx'- rested wihien federal and local offi- cers ralded a “convention of the ommunist party” near Bridgeman, Berrien county, in Avgust, 1922, Six- ty others alleged to have participat- ed in the meeting but who were not apprehended in the raid weére in- dicted with Ruthenberg and his com- panions. The list inciudes William Z. Foster, Rose Pastor Stokes, Ben Gitlow and others. Ruthenberg gnd Foster were tried in the' Berrien eir- cuit coyrt. Ruthenberg was con- victed and the jury 'n disagreed.
