He was 54 years old. During the Roosevelt- Taft campaign for the republican nomination in 1912, Mr. Gruber was a bitter opponent of Col. AUTHORITIES To Acquire Control of B. & M., Contends Government New York, Dec. 10.—Testimony in- troduced today by the government at the trial of the eleven former direc- tors of the New York, New Haven and Hartford railroad under the Sher- man law, was intended to show that influences were brought to bear by the New Haven upon the authorities of Massachusetts to secure the enact- ment of legislation to enable the New Haven to acquire control of the Boston and Maine railroad and ap- proval of the acquisition after this had been accomplished. This was put in by the government on the re-direct examination of Charles S. Mellen to controvert tes- timony by the defense to the effect that the New Haven had legal sanc- tion for the Boston and Maine ac- quisition. Conferred With Draper. Mr. Mellen admitted that Timothy E. Byrnes, vice president of the New Haven and legislative agent, was in conference with the late Governor Draper on the subject of the message that the governor sent to the Massa- chusetts legislature in 1909 recom- Boston Railroad Holding Act, which enabled the New Haven to control the Boston and Maine, and that a copy of the bill was sent to the witness “for sug- gestions” before it was sent to the legislature.
