It is also expressly ordained by the City of Lakeland that no privilege shall at any time be given to any other gas com- pany by the City of Lakeland, unless upon the same conditions as are herein contained, unless the said Rosco Nettles and his asso- clates, successors and assigns, as an individ- ual or individuals, or as a body corporate or to become corporate, shall be granted equal privileges, The City of Lakeland expressly reserves the right to purchase the property of the sald Rosco Nettles and his assoclates, suc- cessors and assigns, as an individual or in- dividuals, or as a body corporate or to be- come corporate, in its plant and fixtures at the expiration of this franchise, for its fair market value, to be ascertained by compe- tent engineers in this line of business. One to be chosen by the City of Lakeland, and one to be chosen by the sald Rosco Neitles and his assoclates, successors and assigns, as an individual or individuals, or as a body cor- porate or to become corporate, and if these shall not be able to arrive at an agreement, they shall call in an umpire, who shall be a thorough business man, and in the opinion of sald arbitrators competent to pass upon the questions involved, and the three persons thus selected shall have power and authority to fix the price at which the City of Lakeland shall have the right to take over the properties if they so desire, provided, that nothing in this section, or in this ordinance shall oblige the City of Lakeland at any time to pur- chase the property of the sald Rosco Net- tles and his assoclates, successors and as- signs, as an individual or individuals, or as a body corporate or to become corporate, un- less the city commissioners, with the approval of the mayor, shall deem it to the interest of the City of Lakeland to make said pur- cha T above umpir ovided, further, that if the engineers, as stated, are unable to agree upon an then it shall be their duty to apply to the judge of the circuit court in which the City of Lakeland may be situated, to ap- point the umpire, and when so appointed the three persons named sb constitute the board of arbitration for the above stated pur- pose. Straight ahead for half 9:2 a mile was one of the steepest grades in the division.
