Cost A deed of _ le for $150,000 was filed this week by Monroe County Commissioners for the purchase of Meacha.n field’s 156 acres from Key West Improvemen: Inc. County Legal Advisor Paul Saw- yer, authorized by the Commission, completed the sale with Key West Improvement Inc. and filed the deed in the courthouse Wednesday at 10:30 a. m. The deed is signed by the five County Commissioners, and for the company Vincent Conley, pre- gident, and Charles Helberg, sec- fetary of the company. The deed gives a detailed des- eription of the boundaries of the 156 acres and is accompanied by @ property map showing it. C. G. Bailey, registered land surveyor did the job for the company. The deed states that the tract of land is sold to the county “for the sole and exclusive use and purpose of intinuously using, occupying, intaining, conducting end operating there- med ry lities incidental to public avia- tion in strict accordance with Federal and Florida State statu- tes, rules and regulations con- trolling public aviation, and sub- ject always, hcwever, to the con- ditions, provisions and terms herein set forth, to-wit; 1, That that certain part or area of the herein described property shown upon said Property map as lying between those certain par- cels therein designated U. S. Gov- ernment and ‘Key Wester” on the southeasterly portion of the said tract and having a frontage of 311.26 feet upon South Roosevelt Boulevard and extending norther- ly along the east boundary of said U. S. Government parcel a dis- tance of 569.70 feet and northerly on the westerly side of the parcel Key Wester a distance of 450.13 feet shall not be used at any time or in any :anner whatsoever for the operation of aircraf: upon said area; andPROVIDED FUR- THER that said part or area shall only be used in conjuction with said airport for the purpose of surface or land pedestrian or ve- hicle ingress and egress to and from said airport or for the con- struction, maintenance and opera- tion thereon by the County of necessary administration build- ing, ticket booths and hangers and for the public aviation facilities of said airport. 2. Service Day or Night All Work Guaranteed FREE PICK UP AND DELIVERY P. 0, BOX 631 PHONE 2286-W KEY WEST, FLA. ficially related thereto and acti- vities normally associated with the operations of a governmen- tally owned public airport and only for so long and until the public need for such airport use shall be necessary for the Coun- ty, such necessity or need to be determined by the county and the Civil Aeronautics Administration of the United States Government “AND IT IS FURTHER PRO- VIDED, that a breach, lapse or discontinuance of the foregoing condition subsequent shall cause said premises and the title to the property herein granted and con- veyed to revert to the Key West Improvemen Inc, its successors and assigns: PROVIDED FUR- THER, HOWEVER, that such re- verter of title to the company and the reacquisition of said pro- not take full effect mpany, its successors or assigns, shall repay to the county the hereinstated cash con- sideration of $150,000 paid by the county to the company for this, grant and conveyance, plus the then value of such permanent and immc rable buildings as shall have been constructed upon sald premises by the county during its tenure hereunder, but in no ¢vent fo exceed original cost of con- struction of such building, which said then value of such buildings shall be determined as follows: “a, By mutual agreement be- tween the company and the coun- ty; or “b. In the event that then value of such buildings, limited as afore- said, shall sot, at the time of re- verter to and reacquisition by the company, be mutually agreed up- on by the cumpany anc the county, then in such event the then value shall be affixed and determined by a board of Arbitration of 3 mem- bers, of which the company and the county shall each appoint one mem- ber and the two so appointed shall appoint a third member, and the said Board of Arbitration so ap- pointed shall, after prompt and due hearing and consideration, fix the then value of said property, but not in excess of cost of con- struction, and the decision of said Board of Arbitration shall be final and binding upon the respective parties; PROVIDED ALWAYS that the said then value of such build- ings as fixed by said Board of Arbitrators shall in no event ex- ceed the original cost of construc- tion thereof, as aforesaid. “PROVIDED ALSO FURTHER that the company shall pay the said $15,000 plus the then value of said buildings, determined as- aforesaid, on or before six months after the determination of the then value of sald building, as herein provided. “3, That the county, in its operation of said tract for said public airport uses and especially with reference to take-off and landing by aircraft thereon, shall have due regard for the safety and security of adjoining properties and persons residingor dwelling thereon “4.
