ORDINANCE AMENDING SECTIONS 28.7 TO 28.20, INCLU- SIVE, OF CHAPTER 28 OF THE CODE OF THE CITY OF KEY WEST, FLORIDA, 1952, RELA- TING TO TAXICABS, BY DIS- TINGUISHING BETWEEN THE OPERATOR OF A TAXICAB AND THE DRIVER OF A TAXICAB; PROVIDING CERTAIN ADDI- TIONAL REGULATIONS CON- CERNING THE OPERATING AND DRIVING OF TAXICABS; LIMIT- ING THE NUMBER OF TAXI- CAB OPERATOR’S LICENSES IS- SUED TO WAR VETERANS AND FORMER MEMBERS OF THE MERCHANT MARINE; AND PRO- VIDING WHEN ORDINANCE GOES INTO EFFECT. Be it enacted by the City Com- mission of ‘The City of Key West, Florida: Section 1. That Sections 28.7 to 28.20, inclusive, of the Code of The City of Key West, Florida, 1952, bs hereby amended to read as fol- 8: Section 28.7 DEFINITIONS AND DISTINCTIONS. The following def-} initions shall govern in the con- struction of this article, and in all proceedings under this article, un- less a different meaning is appar- ent from the context: (a) “TAXICABS” A “taxicab” is hereby defined to be any motor- driven vehicle for the transporta- tion of passengers for hire and which is operated wholly or prin- cipally within the corporate limits of the city, except cars rented without driver and motor buses operated by the city or pursuant to |GENERALLY. All operators and franchise authorizing the operation thereof. (b) “LICENSE” OR “OPERAT- OR’S LICENSE” The words “‘li- cense” or “operator’s license”, as used in this article, shall mean the written authority granted by the City Commission of the city pur- suant to the provisions of this arti- cle to operate one or more taxi- cabs within the city. (c) “DRIVER’S PERMIT” The words “driver’s permit”, as used in this article, shall mean the written authority granted by the City Com- mission of the city pursuant to the provisions of this article to any person to drive a taxicab upon the public streets of the city. (4) OPERATORS AND DRIV- ERS DISTINGUISHED. “To oper- ate one or more taxicabs” shall mean to engage in the taxicab business with such taxicabs in the) city by causing taxicabs which are under one’s ownership or control to} be propelled, either by himself or) by someone under his direction or) supervision, for the purpose of car- rying passengers for hire. An “op-| erator” is a person who operates) one or more taxicabs. “‘To drive a) taxicab” shall mean to be physical- ly in control of a taxicab whether or not such taxicab be in motion, when such taxicab is being used for, or is available or ready to be used for the carrying of passengers for hire. A “driver” is one who drives a taxicab. The same person may or may not be both an oper- ator and a driver. Section 28.13 REVOCATION. Any operator who drives a taxicab, or any taxicab driver holding a per- mit to drive a taxicab in the city, who is convicted of driving while under the influence of liquor or of reckless driving shall be subject to having his license revoked or sus- pended for not more than one year within the discretion of the City Commission; provided, however, that upon a second conviction for driving drunk, the license of any operator or the permit of any taxi- cab driver shall be revoked for a period of not less than two years or permanently within the discre- tion of the City Commission. Section 28.14 RULES AND REGULATIONS. The City Commis- sion shall have the right to pro- vide rules and regulations for the government of taxicab operators and drivers within the city, which rules and regulations shall be bind- ing upon all taxicab operators and drivers licensed to operate and drive taxicabs within the city. Section 28.15 FORM OF APPLI- CATION; FILLING OUT AND FILING; EXAMINATION OF AP- | PLICANTS. The City Commission shall have the authority to provide a form of application to be sub- mitted by any person desiring a license as an operator or a taxicab driver’s permit within the city. Such application must be filled out and submitted according to the rules and regulations prescribed by the City Commission, and the said City Commission shall have the au- thority to examine individually each and every applicant for a li- cense as an operator and a per- mit as a taxicab driver at a time to be decided upon by the said Commission. Section 28.16 OATH TO BE SIGNED BEFORE ISSUANCE. Be- fore an operator's license or taxi- cab driver's permit is issued to any applicant, such applicant must sign the following oath: Key West, Florida, —_—_, - I hereby agree to abide by all laws and rules relative to the operating or driving of a taxi and/or the use of a taxi occu- pational license in The City of Key West, Florida. Section 28.171 LIMITATION OF LICENSES TO EACH OPERATOR. The number of operator's licenses issued to one person, firm or ebm- Pany within the city shall not ex- ceed five (5). Section 28.18 TRANSFERABILE TY. No license or permit issued under provisions of this article shall be transferable in any man- ner whatsoever. Section 28.19 OPERATING WITHOUT LICENSE. It shall be unlawful for any person to operate a taxicab or taxicabs within the city without first obtaining a li- cense so to do as heretofore pro- vided. Section 28.191 DRIVING WITH- OUT PERMIT. It shall be unlawful for any person to drive a taxicab or taxicabs within the city without first obtaining a permit so to do as heretofore provided Section 28.20 FORFEITURE OF LICENSE FOR FAILURE TO CARRY ON BUSINESS. Any oper- ator or driver licensed under the provisions of this article who fails to carry on such operations for as much as ninety days during any six-month period hereafter shall forfeit his license as such operator, or permit as such driver, and the City Commission of the city shall thereupon declare such license @ permit forfeited. Section 2. This Ordinance shall ge into effect immediately upon its Passage and adoption and authenti- cation by the signature of the pre- siding officer and Clerk of the Com- mission, and publication thereof one time in a newspaper of general circulation published in The City of Key West, Florida.
