Lou Carbonell Braving the Heat, Ju GOVERNMENT HAD FIN ISHED ITS CHARGE TO Sailors Fined After FEDERAL COURT JURY AT NOON Indications were at noon today that the fate of David Joseph Watson, negro Navy trial for murder of a white ship- mate, would rest with the Fed- eral Court jury by late this af- ternoon. Defense Attorney John G. Saw- yer, Key West, had started his argument in an effort to save Watson from death in the kill- ing of Benjamin Leroy Hobbs at noon today. The trial was to be resumed at 2 p. m. Sawyer began his defense ar- guments before the jury after U, S. Attorney Herbert S. Phil- lips had concluded summing up the government's case before the jury. Phillips took only about ten minutes to sum up the case. After the other defense attor- ney, A. C. Dressler, Miami, argues before the jury, then Phil- lips would finally sum up for the government. That concluded, Federal Judge John W. Holland would submit his charges to the jury. Phillips said that the govern- ment had proved beyond a rea- sonable doubt that the Federal Court had jurisdiction in the case because Hobbs was killed on the USS Stribling as it lay moored to a dock in the Navy Base here. A “The defendant, Watson, has made a written statement in whieh he admitted he had com- mitted the crime of murder,” said Phillips to the jury. “There is fo qlestion, “then, “about” the crime having been committed by Watson. “The only question that is be- fore you is the mental condition of Watson at the time he killed Hobbs. If he knew right from vrong at the time he killed young Hobbs, then he is guilty of first degree murder. In other words, his mind was not diseased ot the time of the killin, “Watson knew he was going to kill Hobbs, for he said to him: ‘I know you. I'm going to report you.’ Then he struck Hobbs on the head with a wrench. Next he deliberatelyg tied a rope around the sailor's neck. “Then Watson left the scene, but he came back. He found the body still warm, so he choked Hobbs. Then he committed an immoral act upon Hobbs. There is no question of the guilt of this man, nor of his mental condition at the time he killed Hobbs.” Phillips told the jury that first degree murder was premeditated murder and then Watson had premediated the killing. Before Phillips began charging the jury, the 14 jurors were taken from the room while Judge Holland read to the lawyers pres- ent the charge he planned to make to the ju at the con- clusion of the case. Judge Holland made deletions with reference to the jurisdiction of Federal Court from his charge to the jury in the first trial of Watson here last November. Then the judge read his charge as it related to the insanity of the defendant he went along.
