INDIAN TREATY NOT IN FORGE dudge Amidon Holds Convention of 1851 Was Abrogated by Act of Congress in 1863. Judge C. F. Amidon, in United States eourt at Fergus Falls, handed down a decision discharging P. J. Sullivan, the alleged Browns Vailey blind pig pro- prietor, the Indian treaty of 1851 abrogated and annulled. Sullivan was charged with introduc- ing 900 pints of liquor into Browns Valley contrary to the provisions of this treaty. He was sentenced to jail, but later discovered the act of con- gress passed in 1863 annulling the land | rights and cutting off the annuities of | the Sioux in retaliation for the mas- sacre of 1862. After an extended review of the case Judge Amidon sums up as follows: “In the »resent case it is conceded that the Indian reservation, which was intend- ed to be protected by article 5 of the treaty, ceased to be an Indian reser- vation by the act of Feb. 16, 1863, and | since that time none of the Indians have dwelt upon that reservation or claimed title thereto. The whole basis, therefore, of federal authority over commerce in intoxicating liquors in this territory is wanting. There are no Indians there with whom commerce can be carried on; therefore the na- tional government has no power to regulate commerce in the territory covered by the treaty when congress annuiled all rignts of the Indians in these lands. It, by a necessary impli- cation, abrogated 5 the section 5 of treaty, whose only object was the pro- tection of the Indians. Under this de- cision the federal officers have no fur- , ther power to interfere with the liquor traffic in the wide extent of territory covered by the Sionx treaties.” The territory affected by the de- cision includes the city of Moorhead and almost the entire southern‘part of the state lying west of the Mississippi, including part of Minneapolis. DENY SEEKING SENATORSHIP Eberhart and Others Not After Clapp’s Seat From Minnesota. Gevernor Eberhart emphatically as- serts that he is not a candidate for the United States senate to succeed Moses E. Clapp. He declares that under no circumstances will be be a candidate at this time. How the report originat- ed he cannot say. It was never men- tioned, he says. other man in W. ngton, He admits | that senatorial ambitions for the fu- ture are in his mind, but at present being governor is enough. Frederick C. Stevens says he is not and will never be a candidate for the United States senate. He does not think there is any excuse for an attack on Senator Clapp Thomas H. Shevlin of Minneapolis joins the “not a candidate” class by saying he will not run. Frank B. Kellogg declines to say anything on the subject and James A. Tawney says the report is news to him. ‘ “LID” INJUNCTION IS DENIED Bemidji Saloon Keepers Appeal to the Federal Court. Judge Willard of the federal court in Minneapolis denied the application of Bemidji saloon keepers for a tem- porary injunction restraining W. E. Johnson and other Indian agents from elosing the saloons of Bemidji. The order, however, declared that the de- cision would not. prejudice the ‘case); and set Jan. 10 for a hearing on the application for an injunction on its merits . Judge Willard’s order will have no effect on the. status of the case. It was agreed that the situation would remain in Statu-quo until finally de- termined by the courts. FATAL END TO A FIST FIGHT One Dead and One Injured in Braw! in Duluth Hotel. One man is dead and another may die as the result of a fist fight on the “Bowery” at Duluth. Jorgen Hendrickson of Christiania, Norway, is the dead man. The name of the other victim is unknown. As he delivered the fatal biow he reeled from a stroke of Hendrickson’s fist and fell down a stairway, receiving in- juries about the head from which he is unconscious Nothing was known by other per- sons in the hotel of the cause of the fight. Drowned While !ce Boating. While ice boating on Ripley lake at Litchfield, Nora Peterson, aged nine teen, was drowned and Hasold Weeks, Glen Lacy and Miss Fay Wheeler nar- rowly escaped a similar fate. The party of young people had been out on the lake with the iceboat enjoying the moonlight for some hours, when they ran into a stretch of open water several hundred rods from shore. All four were precipitated into the icy waters of the lake, from custody and declaring , between him and any | ; “RULING OF SUPREME COURT | City of Mankato Must Defend Impure | Water Suits.
