Present: Commissioners McWilliams Trebilcock and Mullins. The mijutes of the last meeting were read and upon motion of Com- missioner Mullins seconded by Com- missioner Trebileock were approved by unanimous vote. The following communications were read and filed: From Minnesota State Sanitorium to Dr. Thos. Ruswell re- garding the admission of Wm. Lof- pied. State Highway Commission re- gaping meeting of road makers as- sociation, Ed. Harder regarding claim for damages by reason of the estab- lishment of a highway over his land. ‘Framcis R. Shunk, Major Corps of Bngifieers, United States Engineers office St. Paul, regarding the draw bridge across Pokegama thorofare. The matter of the petition of the |’ board of supervisors of the town of Nashwauk for the apportionment be- uween the towns of Nashwauk and the town of Greenway of certain indebtedness of said town of Nash- wauk and was then heard. A'ttorney Alfred L. Thwing appearing for the petitioners and Senator C. Cc. Me- Carthy for the town of Greenway. Commissioner Trebilcock moved the adoption of the following resolution: “Whereas, on and prior to July 13, 1908, the town of Nashwauk in this county, legally comprised ail of govern ment townships 56 abd 57, range 22, and 56 and 57,, range 23, amd on said July 13, 1908, pursuant to pro- ceedies duly had, this board duly set off from said town said govern- ment townships 56-22 and 56-23, as the town of Greenway; and, whereas, the total indebtedness of said town of Nashwauk at the time of said di- vision was $10,111,98. Evidenced by legal outstanding orders of said town, and, with accrued imterest thereon, amounts at the present time to $11,- 447,02; and, whereas, the valuations of the property in said respective towns at the time of di- n were as follows: Nashwauk $6,- 10; Greenway, $3,928,491; and, reas, the supervisors of — safid town of Naghwauk have petitioned this hoard that st apportion said dn- debtedness and interest; and whereas it.appears.that no such. apportionment has been made; and, whereas, both said towns have bean represemted at this meeting: Now, be Wit resolved, that it seems right and proper that said indebted- ness be awd it @s hereby ‘appontion- ed in praportion to the said assessed valuation of said towns, as follows: To be paid by said town of Nash- wauk $6,904.19; and to be paid by said town of Greenway, $4,506.83; and that the county auditor be and és hereby instructed, authorized and directed {0 add to the taxes levied on the real and personal property of said_town of Greenwap for the year 1910 an amount sufficient to meet the amount apportioned to said town as afore- safi, same to be a spec ‘al levy and fund for such purpose. The motion for the adoption of t+ Resciution was seconded by Commis sioner Mullins and carried by unanim ous vote. The matter of the hearing upon the applications of Gust Jchuson, and Jas. R. Wolfron for liquor license at Snowpall was then taken up 2) d up- on motion of Commissioner Trebil- cock seconded by Commiss.cner Mul- lins id applications were rejected by unanimous vote. A petition signed by residents and freeholders of the town of Popple requusting the board to imspect a proposed bridge across Bigfork river, for which said xown had voted a tax levy att the last anpual town meet- ing, was then taken up. Commission- er Mullins moved .that said petition be rejected, the said bridge being a matter gor action by officers of the town ef Popple. The motion was sec- onded by Commissioner Trebilcock and carried by unan‘mous vote. A petiitien was ited’ nequeést- ing the board to cause to be opened, constructed and put im condition for travel county road No. 67. Upon motion said petition was laid over to the mext meeting for further consider ation. An adjourrment. was then to 1:15 o’clock p. m. Pursuant to adjournment the board again met at 1:15 o’clock p. m. All members of the board present. A petition for the establishment of county road No: 79 was then con- sidered and heard. A petition was presepited for the establishment of a hignway begin- ing #t the corner of sections 9, 10, 15 and 16 of township 149 range 27 amd running thence west amd north tol the northeast corner of the SW% of section 12, township 149. range 28, Commissioner King moved that a hearhg be had upon sald petition at, the court house in the village of Grand Rapids on .Tuesday the 7th day of March, 1910, at ten o'clock a. m.; that Comt C. M. King, M. O’Brien and Neil Mullins members of this! board be a committee to ex- amine the route of said road ard tha said committee meet at the point of of beginning of said road on Tuesday ‘the 28th day of February, 1910, at 10 o'clock a, m. for the purpose of ex- amining ‘the route of said road; that said committee make report to this board at the thme set for hearing upon said petition; further, that said highway and ail proceedings im con- nection with the establishment of the same be known and designated as county road No. 80. The moticn -Was seconded by Commissioner 0’ Brien and carried by upanimous vote. Commissioner King moved the ad- option of the following resolution: “Resolved that the amounts of ‘bclads ito be furnished by the follow- ing office: company surety in the sum of $100,000,00, Res- ister of Deeds with &. J. McGowan as principal and the American Surety company of New York as surety in the sum of $5,000.00. Judge of Pro- bate with Clarence B. Webster as principal and the National Surety cor pany as surety im the sum of $1,- 00.00. Sherfff with Thos. T. Riley as principal and the American Shae bemipamy of New York as surety in the sum of $5,000.00; County surveyor with Johm A. ‘Brown as principal and W. C. Gilbert and B. C. Fimnegam as sureties iin the sum of $500.00. Commissiomer King moved that the chairman appoint a committee of four to meet, with the committee of the Koovhiching county board to make a settlement between the two counties. Said committee to ‘meet at ithe court house, Grand Rapids, on a date te) be agreed upon between the | 12th and 17th of Japuary, 1911, The motion. was seconded by Commission- er O’Brien and carried by unanimous volte. Chairman McWilliams then appoint- ed Commissioners King, O’Brien and Mallins amd County Auditor Spahg as such commititee. Commissioner O’Brien moved the adoption of the following resolution: “Whereas, certain matters relating to the collection of the amount due Itasca county from the county of Koochiching upon the division of the county of Itasca and the organization of the county of Koochiching, are still unsettled, and certain claims exist im the favor of the county of Itasca against the Metropolitan surety company of New York, and the Na- tional Surety company of New York for any shortage existing on the bonds of Arthur A. Kremer, ex-county treasurer of said county. And, where as, the said matters are still unset- esl and unsatisfied, and whereas, Frank F. Price, county attorney of sa‘ county is familiar with all the facts in the case amd better aible to secure an adjustment of the same with the county of Koochiching and the respective bonding companies before referred to: And whereas, the said Frank F, Price is ajbout *o retire from the office of county at- torney, om the finst day of January, A. D., 1911, amd whereas the board of County ‘Commissioners deem it advisable to retain the services of the said Frank F. Price after the first (day of January, A. D., 1911, for the @urpose of adjusting the claims of Itasca county aga‘nst the county of Koochiching and the Metropol‘tan Bonding company of New York ard ‘the National Surety company of New York and for the purpose of looking after the interests of said county im reference to certain se- eureties now ‘held by Charles EH. Aiken as receiver appointed by order of the district court. Now therefore, be it resolved. That the services of Frank F. Price @. attorney at law be and the same are hereby retained by this board to acti as attormey for the county of Ktasica for the purpose of effecting an adjustment and settlement be- tween the county of Itasca and the county of Koochiching, and also be- tween the coumty of [tasca and the Metropolitian Surety company and National Surety company both of New. York. Be it further resalved that the said Frank F. Price be paid tihe sum of $15 per day for aii time actually experded im the settlement and adjusting of said matters and that in addition thereto the said Frank F. Price be reimbursed ail moneys actually expended by him in | expenses in any way connected with said matters.”” The motion to adapt the resolution was seconded by Commissioner King and carried by unamimous vote.
