B the Associatec Press A proposal by Senator Andrews, Democrat, of Florida for a flat en- largement of the Supreme Court to 11 Mmembers received consideration today by Senators seeking a compromise for | the Roosevelt judiciary bill. l Informed Senators said administra- | tion leaders had encouraged Andrews, | possibly with a view toward accept- | ing his suggestion as a substitute !nr{ the President's recommendation to add up to six justices unless those | over 70 retire. ! Andrews declined to discuss the situation, other than to say that in- | creasing interest in his proposal had | been evidenced. Under it the Supreme Court eventually would be constituted of & Chief Justice appointed from the country at large and 10 associate jus- | tices, one appointed from each of the Cireuit Court districts. l One Judge a Year, | Provision might be made, it was said, to qualify Andrews' scheme by allow- ing appointment of only one additional Justice in a year. Andrews also has proposed a con- stitutional amendment to force re- tirement of justices at 75. This, too, | would stipulate that the associate jus- | tices represent the Circuit Court dis- tricts. | Opponents of the bill said they un- | derstood an amendment by Senator Hatch, Democrat. of New Mexico for & court of fluctuating size had not yet been discarded by administration sup- porters. Hatch Proposal. ‘The Hatch proposal would authorize the President to appoint one addition- al justice a year for each justice over 75 years until a maximum of 15 was reached The number would drop back gradually as the older justices left the bench. Senator Burke, Democrat, of Ne- braska reiterated that any enlarge- ment would be resisted in months of debate, if necessary. Indications were that the Judiciary Committee report opposing the Roose- velt bill would be submitted to the Benate in a day or so, unless major revisions were made. | Discussions of strategy when the' Benate takes up the measure engaged 8enators on both sides.
