—18 *%3 FEARS OF UTILITY AGT DISCOUNTED Healy Believes Gloomy Pre- dictions Will Fail to Materialize. BY EDWARD C. STONE. Judge Robert E. Healy. member of the Securities and Exchange Commis- sion, declares the chaos forecast when the commission begins adminis- tration of the public utility holding company act of 1935 “will disappear in the same way that 8 the chaos in the security markets failed to develop when the commis- sion first began operations.” In a recent address he said the markets and exchanges are more stable now than ever before and trading is better than it was because it is more | of an-investment market. due to an im) d margin situation. There is| less~ manipulation because of self- policing by certain exchanges. The question of the constitutionality of the utility act should be settled as soon as possible, Judge Healy said, referring to the plan of the Edison Electric Institute to test the act. in- stead of wasting two years of effort and then having the commission find itself where the N. R. A. is. "I be- Robert E. Healy lieve the commission will do its part in facilitating an early decision on | the question if that is what the in- dustry wants.” The commission has ktart toward regulation the-counter markets, Judge Healy | £aid, raising the question of whether | 1ssuers on this market should not have the same regulation as issuers registered on exchanges. On a rough | estimate, there are 6,000 to 10.000 issues on the over-the-counter mar- ket that can be considered active, with $10,000,000,000 market value of stocks and $45,000,000,000 par value of bonds. Referring again to utility legisla-| tion, Judge Healy called it an effort| to deal with a national problem na- | tionally. It is designed to supplemem‘ State regulation. The ultimate <u(‘»‘ cess of this act will depend upon | the co-operation from a reformed in- | dustry in its own interest, he said.! Mary Anderson to Speak. | Miss Mary E.
