In keeping with his expressed wishes Associate Justice William Hitz, who died suddenly yesterday, will be buried privately in Rock Creek Ceme- tery. The date of the burial has not been announced. Justice Hitz was stricken with a heart attack while preparing to leave his home yesterday morning for the United States Court of Appeals for the District, which he had served as an associate justice since 1931. The decision of the family to forego any kind of public funeral was, ac- cording to friends, in accordance with a wish expressed by Justice Hitz shortly before his death. It was said both of his parents were buried in this manner. Friends Are Notified. Close friends of the justice, many of whom are away for the Summer, have been notified not to return to the city. The District Bar Associa- tion, which had designated a commit- tee to attend the funeral, has noti- fied the committee members that there will be no services. Justice Hitz, who was 63 years old, had served on the Federal bench here since 1916. His career as a justice both with the District Supreme Court and on the Court of Appeals, was marked by a high degree of efficiency and a genuine sympathy for the un- fortunates brought before him. Despite the suddenness of the heart attack, lawyers close to him said, he had not expected to live long and had devoted the last few days of his life to putting his personal affairs in order. Justice Hitz underwent an operation about a year ago and had been in poor health since.
