B—S = LER EXTRADITION £ APEALISSTUDID Decision Expected Monday. Charges of Bad Faith Ex- changed at Hearing. By the Associated Press. NASHVILLE, Tenn., February 3.— North Carolina’s demand for Col. Luke Lea and Luke Lea, jr. was taken under advisement late yesterday by Gov. Hill McAlister after an extradition hearing during which insinuations of bad faith were exchanged by opposing counsel. McAlister indicated he would decide the mater Monday. Col. Lea, newspaper publisher, former United States Senator end long promi- nent in Tennessee politics, and his son were convicted in Asheville, N. C.. in 1931 of conspiracy to defraud the Central Bank & Trust Co., now defunct, of more than $1,000.000. The elder Lea was sentenced to 6 to 10 years' im- risonment, and Lea jr., to pay $25.000 fines and costs or serve two to six years. “I would saw from a perusal of this record that it exhibits s disregard law, a disregard for right,” said Henry E. Colton of the Leas’ counsel in re- ferring to the North Carolina' court documents. “I can't understand it on any grounds except that the political prominence of the men here caused their conviction.” Denying that the Leas had been con- victed unfairly, Solictor Zeb V. Net- ties of Asheville and Assistant Attor- ney General A. A. F. Seawell of North Carolina pointed to the failure of the Leas to lpglelr in person and to the fact that their counsel had not dis- closed their whereabouts except to say they were in Tennessee. ' “T don't want to get personal,” Net- tles sald, “but if these gentlemen are in good faith in this matter, why is it that the location of their clients to- day is a mystery?” The arguments revolved about the questions of whether North Carolina had jurisdiction in the case of the Leas and whether they were fugitives from Jjustice within the meaning of the Fed- eral Constitution and acts of Congress. “Quite a record has been made here,” Gov.
