A—16 wx» CAPONE FILES PLEA FOR A REHEARING Insists Indictment Was So Indefinite as to Be Fa- tally Defective. By the Associated Press. Al Capone, the Chicago gangster now serving a sentence in the Atlanta Peni- tentiary for evasion of Federal income taxes, today asked the Supreme Court to reconsider its recent action refusing to review his case. Michael J. Ahern, counsel for Capone, in asking the rehearing, Croverument had admitted asserted the the indict- Paent on which his client had been con- victed was so drawn that Capone was not protected against a second prose- cution for the same offense. He declared the court must have| overlooked this fact and he insisted the indictment was so indefinite as| to be fatally defective. Ahern also argued the 10-year sen- tence was imposed for offenses which were shown by the Government to have been barred by the statute of limita- tions. A Massachusetts tax-evasion case, in ‘which the indictment was set aside because it was not brought within three years from the date of the al- leged evasion, was cited. Ahern contended the indictment on its face showed Capone was a resident continuously of Chicago from the time the tax evasion is alleged curred until the time of to have oc- his indict- ment and that the Government was therefore deprived of an opportunity to excuse its delay in bringing the pro- ceedings by claiming Capone was ab- sent from the district an be located. d could not LYNCHBURG IS SELECTED AS 1933 CONVENTION SITE Bons and Daughters of Liberty End Alexandria Session Election of Offic Bpecial Dispatch to The Star.
