ASKS RULING :| ONPOTOMAG LAND Seeks Reversal of Decision Which Gave Tidal Surface to Virginia. Counsel for the Federal Government have just flled in the United States Supreme Court the brief on which they will base their argument that the Dis- trict of Columbia extends to the high- ‘water mark on the Virginia shore when the highest court hears the boundary line case on April 13. Although the litigation originated be- tween the Smoot Sand & Gravel Cor- poration and the Washington Airport, Inc., the Goveuunent is interested in final settlement of the question because of Pederal improvements in progress on the Virginia side of the river. ‘The Government brief asks that the judgment rendered last October by the United States Circuit Court of Appeals, which held, in effect, that the property between the high and low water marks on the Virginia side was within the limits of Vi ia, be reversed. The Government brief concluded with the following statement: “It 15 a matter of common knowledge that the Government has now in prog- ress and in prospect extensive projects for the utilization and beautification of the land between low and high water marks, similar in character and loca- tion to the lands involved in this suit. “For this reason the contention that these lands do not lie within the Dis- trict of Columbia and the exclusive Jurisdiction of the United States pre- sents a question of controlling interest to the Government in connection with the development of these projects.” ‘The Smoot Sand & Gravel Corpora- tion was dofig work on the Virginia shore under a contract with the Gov- emnment.
