' THE EVENING CAPONE ARRESTED ON VAGRANT COUNT Posts $10,000 Bond After Undergoing Bertillon Procg ess for First Time. By the Associated Press. CHICAGO, February 26— his own home town, “Scarface Ca- pone, supreme gang leader of them ‘all, arrested as a vagrant, today stood by while his attorneys fought to help him escape punishment of the Federal Court, where he is on trial before Judge James H. Wilkerson for contempt. Capone, served with a vagrancy war- | rant issued by Judge John H. Lyle, the gangster “nemesis” was freed on a $10 bond, was photographed and meas ured under the Bertillon system and fingerprinted—a new experience for the gang chief in Chicago. Then he went back to Federal Court, where he heard witnesses give testimony to support the Government’s contention that his ex- cuse that illness prevented him from coming to respond to a Federal grand | ury summons in March of 1929 was aked. ! ‘The grand jury was investigating in- comes at the time, but Capone said he | was far too sick a man to brave the rigors of the Chicago climate. Pilot Describes Flight. Capone sat calmly by while Federal witnesses testified he made a seaplane trip to the Bahamas, went to Nassau on a boat and watched Jack Sharkey and Young Stribling box at Miami dur- ing the period of his purported illness. Edward Nirmaier, pilot of the sea- Pplane, described the flight. “What did Capone do ‘on shore?” he was asked. “He loitered in a club house.” “Was there a bar there? Benjamin Epjstein, Capone’s lawyer, leaped up with an objection at this point, declaring that “the prosecution can only think in terms of bars.” “They,” retorted Assistant District Attorney Jacob I. Grossman, “are synonymous with the defendas Physician Gives Testimony. Epstein, however, won his point, and all the testimony was not against Ca- pone. When the Government had fin- ished, Dr. Kenneth Phillips of Miaml, | %> signed an affidavit that it would | be dangerous for Capone to come to Chicago, said his patient had bronchial pneumonia, with a temperature of 10415. He thought Capone might have died if he had made the trip to Chi- cago. He said he ordered him to re- main in bed. “Confined to bed,” he said, “means that the patient couldn't work or per- form the usual duties of a well man. Of course, he could be carried in his sutomobile and taken for a ride.” This brought a roar from the crowd- ed court room because of the use in gangland of the expression, “taken for - k. ‘The vagrancy warrant was served by | members of the personal squad of De- tective Chief John Norton, who talked 1l over with Capone at the De- tective Bureau during the noon recess. Norton said Capone indicated he want- ed to retire and argued that “certain ?eople were using him for a political foot ball.” When court adjourned the | gang chief was taken to the South | Side, far from the downtown section. John Alcock, acting police commis: sioner, explained why. | We don’t want Capone killed in | Chicago,” he said, indicating that the | spot to which he was taken was safer than the downtown districts. { o 15 OF STEAMER'S CREW | TAKEN OFF IN BUOY | British Vessel Grounded in Fog.
