In the case of Rosika Schwimmer the court last year decided such an oath Was necessary, but since then a_circuit court of appeals has decided Douglas Clyde McIntosh, Yale. theqlogy profes- #or, and Marie Averill Bland, Canadian WAT nurse, were entitled to citizenship in ppite of reservations regarding bear- ing arms. Stalus of Casé Defined. ‘The Supreme Court is to decide shartly whether it will take up the Gavernment’s appeal and review these cases. Should ft. decide not. to review, the decisions of the Court of Appeals Wwill atand, presenting to the eye of the layman & decided contrast to the final ruling It the Schwimmer case. . Schwimmer, native of Hungary, Jecturer, writer and liguist, applied for ecitisenship in Illinois in 1926. Every thing went well until she was asked if she would personally bear arms in de- fense of the United States. She re- plied she would not because she was an uncompromising pacifist. She was refused citizenship and appealed to the Supreme Court. 1 The court ruled against her, the ma- Jority holding it was the citizen's duty 10 bear arms if necessary and that any- thing tending to lessen willingness to fight in time of need weakened the safety of the Government, Three Justices Dissent, Justices Holmes, Brandeis and the Jate Edward Terry. Sanford dissented. Justice Holmes observed in that “many citizens lgrze with the ap- licant’s belief and I had not supposed itherto that we regretted our inability to expel them because they bzlieve more than some of us do in the teachings of the Sermon on the Mount.” In the meantime, MacIntosh and Miss Bland, both Canadians, asked for citi- wenship. Dr. MacIntosh sald he was ‘willing to bear arms tn defense of -the eountry, but wanted to be the judge of the necessity. Miss Bland, like Miss Schwimmer, said she would not bear arms personally, shelleving it contrary to the “ethics of Christ.” Court Ruling Reversed. | Both were refused citizenship in |: Unifed States District Court, but the second Circuit Cour of Appeals, despife the Schwimmer case decision, reversed the lower couft. In the case of Dr. MacIntosh it said there was a distinction between a mor- ally justified and an unjustified war and that recognition had been given this distinction in the Kellogg peace pact.
