The new rule promulgated by the United States Supreme Court last June in reference ‘to the hearing of equity cases became effective yesterday. It will increase the labor of the justices of the) District Supreme Court as well as of thei attorneys engaged in these cases but is éxpected to prove of great benefit to the appellate tribunals. The rule requires the court of first instance to make a finding of facts specially in each case and to state separately its conclusions of law thereon. It is an entirely new practice in the local court, where ordinarily at the con- clusion of & hearing the justice would announce his decision without going into detail either of law or of fact. Un- der the new rule it has not yet been decided whether an opinion i to be ren- dered in each case or whether the re- quired statement of both facts and law points are to be incorporated in the final ‘decree. The justices of the court will take up the question at their meet- ing to arrange for the Fall sessions of | 5 the_court. The rule reads: “In deciding suits in find the facts specially and state sepa- rately its conclusions of law thereon: and its findings and conclusions shall be entered of record and, if an appeal ‘s taken from the decree, shall be in- ciuded by the clerk on the record which !
