CHICAGO, January 16—On the morning of last November 20 Henry Dorr ate breakfast about the time his brother Howard killed a man in the flat next door. Henry Dorr, testifying late yesterday at his brother's ®trial for the murder of William J. O'Brien, made it quite clear about breakfast. A few seconds later there came the report of a shot. | “Then what did you do?” his| brother’s attorney asked. “I went back,” answered Dorr, eat breakfast.” Throughout his testimony, which came as a complete surprise to the | prosecution, Dorr referred to his brother | Howard constantly as “the defendant.” With the brother's testimony, the murder trial today had neared the argument stage. In statements made by Howard Dorr and by Mrs. O'Brien shortly after the shooting a love affair between the two was recited. It is the State's contention that Dorr and Mrs. O'Brien, who awaits | trial, plotted to kill O'Brien, collect his insurance money, and later, by the divorcing of Mrs. Dorr, to be married. Dorr's defense has been that he went to the O'Brien apartment when he heard & woman scream and that O'Brien attacked him, Dorr shooting him in self-defense. If the reasons given are satisfactory to Treasury officials, income taxpayers may be granted an extension of time for filing their returns for 1929. Commissioner Lucas of the Internal Revenue Bureau said yesterday that while there would be no general exten- sion of the period for filing returns, which ends at midnight, March 15, col- lectors have been instructed tc examine requests and to grant them if they were sufficient. Lucas also said that where requests were granted the taxpayer would be re- quired to file on or before March 15 & tentative return accompanied by at least one-fourth of the tax estimated to be due and would be charged 6 per cent interest a year on any deficiency in the unpaid installments from the original due date. PEORIA, Ill, January 16.—District officials of the United Mine Workers of America expected the climax today of the strike vote cast at the Crescent Coal Co.s four mines. Internal dissension within union ranks was given by the operating com- pany as the cause of the rift, which resulted in 1,100 miners remaining away from the mine yesterday. However, George W. Stouffer, district executive board member of the United Mine Workers, called the strike illegal last night and announced that any miner failing to appear for work to- day would be fined by the union $3 for the first day and $1 a day thereafter. Chairmen of the four mine locals followed this with emphatic assertions that the men would not return to work until their demands are met.
