THE EVENIN TAR, WASHINGTON, D. C, SATURDAY, DECEMBER 28, 1929 TRIAL NEARS END AT CORUR DALENE Jury to ~“Whisky Rebellion” Was “ Curse to Idaho Town. By the Assoclated Pr COEUR D'ALENE, Idaho, December 28.—The Federal Court jury which for | 10 days has heard defendants in the Mullan _“whisky rebellion” trial. pic- tured alternately as flaunters of Federal Jaw and as saviors of a tax-burdened fown, soon will be called upon to de- gide ‘which is the more accurate de- scription. Federal Government witnesses re- tounted their activities in the Mountain- Jocked mining town, and testified they found a conspiracy of officials to nullify the dry law, and that this was carried out through a system of licenses, issued by the viilage council. which were al- Jeged to have provided revenue for civic improvements and municipal expenses. Conspiracy Charge Denied. Defense witnesses, including most of the defendants, denied the conspiras charge and defended the license system with the contention that since the city coffers were empty and the populace | determined to have liquor in spite of prohibition. revenue might as well be collected on that basis. In his opening argument yesterda: ‘William Langroise, assistant United - GOFFEE . . . Used Every Day by Thousands “Sanitary’’ and Piggly Wiggly Stores Decide Whether| the village officials agreed on the license system, which would permit liquor sales, gambling and disorderly houses immune from - interference by the law. Need of Recreation. W. H. Potts for the defendants, said: “Many of these men are foreigners, and when they leave their work under- ground, where they have been 1,000 feet below sunshine, gambling with death. they are seeking amusement, the kind they want. Recreation naturally is pro- | vided for them. “The town, long before the advent of any of these defendants, was open. ‘There was gambling, disorderly houses, and liquor was sold. “You must consider the circumstances in deciding whether there was a con- spiracy. The people of Mulland had established this custom (an open town), and for the town it was as strong as the law.” ‘The case may reach the jury | today. B;ths Reported.
