State's attorneys worked on their rebuttal testi- mony by which they hoped to tear lown Judge Hamilton’s plea of self-de- fense. Judge J. E. Carter prepared a preliminary draft of his charge to the | Jury. It was believed the State's principal concern will be an attempt to discredit Hamilton's sworn statement that the shots in his office were fired during a struggle over possession of a pistol. | Hamilton never has admitted that he fired any of the five shots. Minor points the State must answer include alleged | threats against Hamilton and his fam- ily and the flat statement by the former judge and college professor that he did { not know, until after the shooting, that Walton was his son-in-law. An unfamiliar face was expected in the courtroom today. Judge Hamilton's 82-year-old mother, Mrs. N. S. WHITEBURY, Ky., November 4.— Gund blazed in a remote section in the mountains 26 miles form here yester- day, and when the smoke had cleared a deputy sheriff was known to have been critically wounded, and it was re- ported that he had killed his assailant. | Owing to the remoteness of the sec- tion, which cannot be reached by tele- phone, details of the shooting were scarce. The sheriff and other officurs of Knott County were still somewhcre in the hills late last night. Reports sifting into Whitesburg paint- ed a sketchy picture of the shooting, in which Deputy Sheriff Stephen J. Cor- nett is known to have been wounded, | perhaps fatally. The deputy is mn a | hospital at Fleming, Ky., where an | operation was performed last night in | an effort to save his life. The deputy | was shot through the abdomen and a second bullet grazed his head. Accounts of the shooting received here were that the deputy, together with | other officers, had gone to the home of Tom Morton to arrest him on a pro- hibition violation charge when a neigh- bor entered the argument. From there on reports of the shooting differ. One is that the neighbor, said to have been a man named Ashland Collins, shot and wounded Cornett, and that Cornett killed Collins in the exchange of shots. Another report was that Cornett evi- dently wounded an unidentified as- sallant, who staggered off through the woods and was not apprehended.
