Despite his exoneration from complic- | ity in the alleged $1,500,000 civil fraud suit growing out of the sale of surplus lumber from Army cantonments follow- ing the World War, John Stephens, mil- lionaire lumber merchant of Jackson- ville, Fla., has again been drawn into the case by action taken yesterday of the United States Government. At the direction of the Solicitor Gen- eral and the Attorney General, special Government Counsel Willlam 8. Ward and Marcus Borchardt served a citation on Attorney Wilton J. Lambert, attor- ney for Stephens, of the noting of an appeal by the United States from that portion of the recent decree ot Justice Jennings Bailey of the District of Co- lumbia Supreme Court, holding John L. Philips of Thomasville, Ga., indebted 0 the United States in a sum of about $1,500,000, and holding other lumber merchants liable in lesser amounts. The court’s decree relieved Stephens of re- sponsibility for and notice of any al- leged illegal contracts made by Philips and same of his associates. Stephens took the witness stand dur- ing the presentation of the Govern- ment’s case and disclaimed all knowl- edge of any illegal transactions, although admitting that he was named as a part- ner with Phillips in the contract made by the Government for the disposal-of the lumber. ‘The contention of Government coun- sel in noting the appeal is that Stephens ‘was a partner with Philips in the eon- tract and may be held equally respon- sible with Philips under the general partnership liability. By the Assoclated Press. ‘The Varney Air Lines, Inc., of San Francisco, with an offer to carry mail for 9 cents per pound, yesterday was low bidder for the contract to operate the air mail from Pasco to Portland and Seattle and from Pasco to Spokane. - The bid of 9 cents a pound is the lowest ever received by the Post Office Department. The Varney Co. now carries the air mail from Salt Lake City to Pasco, and the leg from Pasco to Seattle will merely constitute an extension of} the present route.
