23 STATE NAY PROBE DE KING SLAYING Legislator to Ask Complete Investigation by'Assemny of Raid Killing. By the Assoclated Press AURORA, Ill, March 29— Legis- lative inquiry into the killing of Mrs. Lillian De King by a county dry raider was threatened yesterday with the an- nouncement by Representative Thomas J-O'Grady of Chicago that he would introduce a resolution in the State sembly asking a complete investigat: ‘The announcement came after author- ities had refused to start a search for Boyd Fairchild, the investigator whose statement that he bought liquor in the De King home brought about the raid. Fairchild has not been seen since the raid, in which Mrs. De King was fatal- ly shot, her husband, Joseph, clubbed, and one of the raiders shot by her 12-year-old son Gerald. Warrant’s Legality Seen as Key. Assistant State’s Attorney Carleton Shults, who employed Fairchild, said he did not know where the investiga- tor was, but he denied the charge of De King's attorneys that Fairchild had been deliberately sent away because he could not identify the body of Mrs. De King as that of the woman who sold him liquor. Shults said the investiga- tor was not needed as a witness. Progress of the case is expected to hinge upon the legality of the search warrant sworn out upon Fairchild's testimony. De King's attorneys have charged that it was not legal for sev- eral reasons, among them that it was used twice, that it was not made out for the De King house, and that the in- vestigators used an assumed name. Fear for Life of Deputy. Roy Smith, the deputy sheriff who shot and killed, Mrs. De King and who in turn was shot by her son Gerald, was in a serious condition in a hospital at Elgin. The bullet wound inflicted by the youth had become infected and it was feared gangrene might set in. The inquest into Mrs. De King's death has been set for next Thursday. At- torney General Osgar E. Carlstrom, aft- ter a request by State’s Attorney George D. Carbary, announced he would send a representative to determine what prosecution, if any, is warranted. A private inquiry into the rights of | dom of-the port was under way today, as an aftermath of the alleged discovery of four bottles of liquor by New York customs officials in the baggage of a Representative who had just returned from the Canal Zone. Congressional leaders were sponsoring an examination of the whole subject, and one member of Congress was represented as believ- ing that doubt exists if any persons who are not diplomatic representatives of foreign powers are entitled to the freedom of the port. Government circles here understand that members of Congress ask and re- ceive the freedom of the port, as dis- tinguished from the mere courtesy of the port, which expedites examination of baggage, but permits of no immuni- ties. Verification was lacking yester- day for the published account of a Rep- resentative returning with four quarts of whisky and members of the party who are in Washington disclaimed any information concerning the incident. .
